SALES/USE TAX RATE/COLLECTION CHANGES EFFECTIVE JAN. 1, 2010

The Department of Revenue, Division of Taxation summary of sales/use tax changes effective January 1, 2010 is included below.  State-collected taxing jurisdictions can only change rates on January 1st and July 1st of each year; dealerships are reminded to check the following state web site near those dates to look for new changes:

While self-collected, home-rule jurisdictions can make changes more frequently, the state includes those changes whenever possible in these updates.  The DR 1002, summary of all Sales/Use tax rates has not yet been updated.   Visit the following state site for state tax forms – you can search by number or title of form:

Most changes below were various localities reducing or eliminating the amount of their Vendor/Service Fee.

As a reminder, dealerships should be utilizing a certified, third party tax database.  While this database should be updated with the changes highlighted above, dealership title personnel may want to double check deals in these areas.

Dec. 8, 2009           THIRD PARTY TAX JURISDICTION DATABASE: PROXIX SOLUTIONS TERMINATING SERVICE

REMINDER: UNIFORM CONSUMER CREDIT CODE - NOTIFICATION FILING AND FEES DUE JANUARY 31, 2010

A new law went effect January 1, 2010 so that ALL “creditors” (which includes dealerships that arrange financing) MUST file a notification form and fee with the state Attorney  General’s office, Uniform Consumer Credit Code Administrator.  The previously hard-to-determine volume fee has also been eliminated, with one, flat notice fee of $50.00  

The filing fee is due by January 31, 2009
(there is a 30-day grace period; late fees of $5.00/day apply as of March 1st).

AND THEY'RE OFF!

The Second Regular Session of the 67th General Assembly convened at the Colorado Capitol in Denver last Wednesday.  As required by the Colorado constitution, the legislative session will run continuously for 120 days, ending sometime during the first week of May.  CADA’s dealer rights bill was filed on the first day of Session, and carried the most co-sponsors and legislative support of any piece of legislation filed that day.  Days later, a joint press release in support of CADA’s dealer bill was sent out by Governor Ritter’s office, the House Majority office and the House Minority office.  To view a copy of the press release, please click here

There were several other bills filed during the first week of Session regarding identity theft, workers compensation/Pinnacol Assurance, and automobile insurance.  CADA will be monitoring these bills as they move through the process.  For additional questions on any legislation, please contact Melissa Kuipers or Tim Jackson.

MARK YOUR CALENDARS - NEXT LPC MEETING IS 2/17/10

For the most up-to-date dealer-related legislative information, please attend CADA’s next Legislative Policy Committee meeting on Wednesday, February 17th at 7:30 a.m. at CADA.  The LPC is an open forum, round-table style discussion group that meets once a month to discuss the current state of politics in Colorado and how it affects you and your dealership.  During the legislative session, your involvement in the LPC is especially critical.  Political activism is one of the many benefits you receive from your CADA membership and you can and should have a say in what we do at the Capitol.  Especially in light of the historic termination of dealers in 2009, we need you to be a part of our political dialogue.  We hope to see you soon!
