TIP OF THE MONTH: CHECK IF YOU MEET THE NEW SPCC RULE COMPLIANCE DATES

Self Certification An Option Starting January 14th 2010
 
After an 11 month delay for additional public comment the EPA has finalized the December 2008 amendments to the Spill Prevention Control and Countermeasure (SPCC) rules. If you recall, last year’s amendments were to reduce some of the regulatory burden on smaller oil handling facilities such as yours. As it turns out, the changes resulting from the extended public comment period have not had any impact on the amendments in your business sector. As with the previous rules if your facility has an aggregate storage capacity of over 1,320 gallons (including 55 gallon drums) of petroleum products, these amendments will affect your facility.

COLORADO DEPARTMENT OF REVENUE ISSUES EMERGENCY REGULATIONS ON RECENTLY SIGNED BILLS
The Colorado Department of Revenue has now issued emergency regulations on the bills recently signed by Governor Ritter that will suspend or eliminate certain tax exemptions, credits and exclusions. These emergency regulations became effective on March 1, 2010.
Please click here for these emergency rules relating to the following bills:
- Energy use (HB 1190).
- Software sales (HB 1192).
- Non-essential articles and containers for food products (HB 1194).
- Internet Sales in Colorado (HB 1193) – Regulations are identified as “revision to doing business in the State,” and “Remote seller’s obligation to provide notice to Colorado purchasers of sales and use tax obligation.”
- Three month waiver of penalties and penalty interest for HB 1190, 1192, 1193, 1194, 1195.

HB 1049 LEGISLATIVE UPDATE
HB 1049 was heard by the Senate Business Labor and Technology Committee at 1:30pm, Monday, March 1st. The bill passed out of the committee by a unanimous vote even with intense opposition by GM and local union workers who tried to persuade members of the committee to kill the bill. CADA was successful not only in passing the bill with a unanimous vote, but were also successful in adding several amendments that substantially strengthen the bill for dealers. The bill will now be heard by the Senate. More details coming soon.
