COLORADO WORKERS COMPENSATION LAW: REQUIRES DESIGNATION OF TWO PROVIDERS AND WRITTEN NOTICE TO WORKERS

REMINDER: On January 1, 2008, House Bill (HB) 1176 took effect.
The law requires Colorado employers to designate two medical providers to treat employees who are injured on the job. The two medical providers must be at two distinct locations without common ownership.
As a reminder, notice of these two designated providers must also be provided to the employee at the time of a worker’s compensation injury or within seven days by certified mail. It has come to light that in many recent cases, employers are not providing this notice at the time of injury.

To review providers and choose your preferred providers if you have not already done so, use Pinnacol ServiceLink. Go to www.pinnacol.com, under "QuickLinks" choose “Manage SelectNet Providers,” and then click on “Manage Medical Providers.” After logging on, you will be able to select your two preferred providers, and Pinnacol will be immediately notified of your choices.
From the ServiceLink site, you can also print a sample “Letter to Injured Worker” that you are required to give to your employee at the time of the injury notifying him or her of your two designated medical providers. If circumstances prevent you from providing the information at the time of the injury, you must notify the injured worker in writing within seven business days of being notified of the injury.

HB 1049 LEGISLATIVE UPDATE
CADA’s priority legislation, HB-1049, won an overwhelming vote of support in House concurrence with Senate changes. The vote mirrored the original House Third Reading vote, 60 to 5. The legislation has now moved to the Governor’s office and awaits his signature. We expect the Governor will sign the bill into law this week, yet no commitment has been made to do that. At any rate, the legislation is soon to be law as it was written with an emergency clause to ensure that it takes affect at the time of signing.
