THE DEALER'S OBLIGATION IN COLORADO TO SELL PROPERLY EQUIPPED VEHICLES

Dealers often ask what is required of them under Colorado law in terms of inspections of a motor vehicle at the time of sale to a consumer. Generally, dealers must deliver vehicles that are safe and have all of the equipment required by Colorado statute in “proper condition and adjustment.” Putting aside issues relating to defective equipment, under Colorado law, sale of a vehicle to a retail customer which is not properly equipped or in proper condition or adjustment can result in denial, suspension or revocation of a dealer’s license. The actual safeguards that a dealer must undertake to insure that every vehicle has the required equipment in “proper condition and adjustment” are less clear, but many, if not most, dealers perform a safety inspection of the vehicle prior to sale.

GOVERNOR RITTER SIGNS HB-1049 INTO LAW
Gov. Bill Ritter on Monday signed into law a bill [HB-1049] that gives Chrysler and General Motors dealers who were closed during the automakers’ bankruptcies a right of first refusal if the companies reopen an area franchise — or a right to demand the franchise back if it already has been reassigned.

PINNACOL BILLS TO BE HEARD BY SENATE JUDICIARY WEDNESDAY
Six of the measures put forth by the Pinnacol Interim committee over the summer will be heard by the Senate Judiciary Committee on Wednesday at 1:30. These bills, largely opposed by Pinnacol, are critical to the ongoing negotiations between the State and Pinnacol relative to Pinnacol potential emerging from state control in exchange for a buyout. The bills that will be heard are: HB 1038 regarding a workers compensation claims brochure; SB 13 regarding workers compensation accountability; HB 1009 regarding the Pinnacol board of directors; SB 12 regarding workers compensation benefits; HB 1012 regarding a limitation on the use of surveillance in workers compensation claims and SB 11 regarding conflicts of interest in workers compensation claims. BUSINESS GROUPS KILL OVERLY BURDENSOME DISPOSAL OF RECORDS BILL
HB 1056, by Rep. Frangas (D-Denver), would have increased the regulation of the process under which businesses dispose of records with personal information of their customers. CADA along with several other business groups, successfully killed this bill in its first Judiciary Committee meeting in the House of Representatives by a vote of 7-2. While we understood the consumer protection goals of Rep. Frangas' bill, dealers in particular are already highly regulated by Federal law on this issue, and to have conflicting or overly burdensome state law would not have been good public policy. Thankfully the House Judiciary committee agreed.
