REMINDER: DEMO PLATES CANNOT BE USED ON VEHICLES DISPLAYING DEALER ADVERTISEMENTS

Dealerships are reminded that demo plates have numerous restrictions under Colorado law.  One that is often overlooked is the following which includes a restriction on advertisements (excerpted from a full list of restrictions available in the link at the end of this article):

Demo plates may not be displayed on any of the following vehicles owned by the dealer:

●  tow vehicles,
●  parts pickup/delivery vehicles,
●  service department loaners,
●  courtesy shuttle vehicles,
●  rental vehicles,
●  haulers, or
●  any vehicle bearing the dealer's name or advertisement (other than the small dealer badge normally affixed to the rear of the vehicle, or the license plate holder bearing the dealer's name).

Visit the June 20, 2007 Issue for a re-cap of both demo and full use plate restrictions: REGULATORY& LEGAL UPDATES, Reminders on Dealer Full Use and Demo Plates

HB 1269 KILLED ON THE FLOOR OF THE COLORADO HOUSE

We are thrilled to report that HB 1269, referred to as the "Workplace Fairness and Civil Rights and Remedies Act of 2010" by Rep. Claire Levy (D-Boulder) and Sen. Morgan Carroll (D-Aurora) was defeated on the floor of the Colorado House of Representatives last week.

This bill would have allowed a plaintiff in an employment discrimination case brought under state law to receive compensatory and punitive damages in addition to the current remedies already available in current law, including front pay, back pay, interest on back pay, reinstatement or hiring, and any other equitable relief.

The bill would have also applied to employers with less than 15 employees.  Under federal law, any claims brought under Title 7 for allegations of employment discrimination are not applicable to employers with less than 15 employees and this bill was attempting to change that to make these claims applicable to all Colorado businesses, no matter how small or large.

After rigorous debate on the floor of the House today, the bill died on a division vote during 2nd reading 32-31-2.  We expected Rep. Levy to run an amendment to the report of the committee of the whole, a procedural move that would have revived the bill.  After realizing she did not have the support to win that amendment, she decided not to run it.  This means that the bill is officially dead and cannot be revived by any future legislative action this Session.

We are grateful to all of the Republican members of the House, 5 key Democrats and 1 Independent, without whom we could not have killed this bill.  These legislators that stood strong with us are:

Rep. Joe Rice (D-Littleton)
Rep. Ed Casso (D-Thornton)
Rep. Wes McKinley (D-Walsh)
Rep. Jim Riesberg (D-Greeley)
Rep. Christine Scanlan (D-Summit)
Rep. Kathleen Curry (I-Gunnison)

If you have any questions on this legislation, please do not hesitate to contact us.
