SALES/USE TAX ALERT:
CASTLE PINES NORTH 2.75% CITY SALES TAX MISSING FROM STATE AND THIRD PARTY DATABASES

It has been brought to CADA’s attention that a city sales tax of 2.75% is effective in the city of Castle Pines North.  However, this tax is <not> showing up on either the certified database (currently Group1), nor on the state IDS system.   The DR 1002 (latest revision date 2/10/2010, see page 3), shows this tax.

[NOTE:  The DR 1002 will be changing soon to reflect the latest sales/use tax changes as of July 1, 2010 – it is typically updated within a month or so after January 1st and June 1st of each year.  Keep in mind that home rule cities may make changes to their tax rates at any time; only state-collected jurisdictions must report changes to the state].    Visit last week’s Open Road article, Sales/Use Tax Rate/Collection Changes Effective July 1st, 2010, for the latest changes.

While there is a state hold harmless provision that protects dealerships that rely upon the third party database, at present there is no effective way to utilize this hold harmless provision other than in a sales/use tax audit that might occur years later.  The interplay of the titling/registration process, the requirement by counties that all taxes be paid before any paperwork moves forward, and the requirement that the dealership must perfect a lien all mean the dealership typically will have to cover the uncollected taxes upfront, even if the database was incorrect.  These additional taxes then have to be collected from the consumer separately.

CADA has contacted both the state and Group1 to correct these databases.  Meanwhile, please ensure that you collect this city tax on any vehicles that will be registered in Castle Pines North.

If you have had title paperwork rejected and/or sales/use taxes that you have been unable to collect from consumers due to this error, please contact us; we would like to determine the extent of this error.

Call to Dealers to Collect Data on these Sales/Use Tax Error Costs

Further, it would be extremely valuable to CADA if dealerships can begin to quantify and track ANY sales/use taxes that you have had to pay on behalf of consumers due to incorrect sales/use tax information in these online sources at the time of a deal.  It would also be helpful  to know the amount you are ultimately unable to collect from the consumer (either because the individual amounts were too small to make it worthwhile, the consumer refused to pay, or other similar reason),  When CADA attempts to advocate on this issue, the most difficult part is to demonstrate the extent of the problem.  The more we can cite the actual costs to dealers of these errors, the better.  Please contact us with any examples, and/or any summary data you are able to track on a sample monthly, quarterly or annual basis.
