REMINDER: REVISED DR 2174 SECURED POWER OF ATTORNEY

The Colorado Department of Revenue made changes to the DR 2174 Secured Power of Attorney in December, 2009. 

The cut-off for counties to accept the prior version was May 7, 2010.  Please be advised that you should now be using the  DR 2174 Secured Power of Attorney with revision date 12/22/09.  Forms can be ordered from CADA by calling George Billings at 303.831.1722, online at http://www.coloradodealers.org/mem_forms_manuals.php or via email george.billings@coloradodealers.org

WASTE TIRE RECYCLING FEE - REMINDERS

A reminder that as of November 1, 2007, Colorado retailers of new motor vehicle tires must collect a Waste Tire recycling fee of $1.50, provide a specific disclosure on each invoice, and file a specific tax return form remitting these fees.   See the Taxpayer Service Division, FYI – General #13 Waste Tire Recycling Development New Tire Fee (Latest revision 07/2010) for further information.   

Key highlights of this requirement:

  • Retailers of new motor vehicle tires must include the following statement on their sales receipt not to exceed fifteen-point, bold-faced type:
    ‘Section 25-17-202,Colorado Revised Statutes, requires retailers collect a $1.50 waste tire fee on the sale of each new motor vehicle tire’.
  • The waste tire recycling fee is to be stated as a separate and distinct item on the retailer’s invoice to the customer.
  • The separate line item of the Waste Tire Fee on the invoice is not subject to sales tax.
  • Motorcycle tires are also subject to the Waste Tire Fee. 
  • Waste tire fees are remitted to the Department of Revenue with the form “New Tire Fee (Waste Tire Recycling Development)” DR 1772 (Latest revision, 8/11/2009). Fees and form are due on the same date the retailer’s “Colorado Retail Sales Tax Return” (DR 0100) is due.

Re-run and updated from the original notice of the fee increase on Nov. 7, 2007.

CADA LEGISLATIVE POLICY COMMITTEE DEALER MEETINGS

The CADA Legislative Policy Committee is scheduling dealer meetings with Colorado state legislators in order to increase awareness and gain support for the many policy issues expected to face auto dealers in the upcoming session of the Colorado General Assembly which convenes January ??, 2011.

Several meetings are planned and you are invited to participate in as many of the meetings as you are able to do.

The primary purpose of this series of brief get-togethers is to foster and advance relationships between CADA member dealers and Colorado’s elected leaders.

The following topics areas are expected to be covered in each session:

  • Auto industry issues in general
  • Colorado dealer issues in particular
  • Proposals to repeal Colorado’s ban on Sunday sales of automobiles
  • Growing class action litigation against the auto retail industry
  • Trends in auto sales in state and nationally
  • Sales tax jurisdictional issues

With the economic challenges faced by the industry today, it is more important than ever that state legislators get the opportunity to hear from you on issues of importance to you and your business.

2010 ELECTION CYCLE REVS UP!

The 2010 election cycle promises to be a very exciting time for the voters of Colorado.  This fall, all of the 65 seats in the Colorado House of Representatives are up for election/re-election, and out of the 35 Senate seats, 19 are up for election/re-election.  Additionally, Coloradoans will have the opportunity to vote for a US Senate seat, 7 Congressional seats, as well as the Governor, Attorney General, Treasurer, and Secretary of State.  As a member of the Colorado Association of Commerce and Industry (CACI), CADA had a seat at the table when CACI conducted its candidate interviews where we collectively interviewed over 53 House and Senate candidates from both the Democratic and Republican parties. 

CADA is in the process of scheduling interviews with several legislative candidates, including several incumbents currently serving in the legislature.  Please watch for future issues of Open Road as we formulate this list of meetings where dealer attendance and participation is key to communicating our core issues, including franchise rights and protections and Sunday Sales, to our elected officials.  If there is a candidate or elected official that you wish to meet with, please contact Melissa Kuipers, Vice President of Government Relations & Communications at 303.457.5115 or melissa.kuipers@coloradodealers.org

ARE YOU PREPARED TO SERVICE HYBRID VEHICLES?

Overall Objective: To teach automotive technicians basic safety for handling hybrid batteries and working with hybrid vehicles. 
Target market – Automotive technicians in the western region of the U.S. wishing to train on hybrid vehicles.
Anticipated class size – limited to 12 students per class
Anticipated duration of training – course will run for 40 hours (see dates and times on attached advertisement)
Learning Objectives and Hands on Training Includes:

  • Demonstrate safety when dealing with hybrid batteries
  • Describe and demonstrate methods of approaching high-voltage systems
  • Describe steps to evaluate if vehicle is safe to touch or work on
  • Be able to locate high-voltage wires in hybrids and all electric vehicles
  • Conversion of hybrid vehicles to longer-range electric vehicles

As you probably know by now, my wife, Betty, suffered a stroke on July 2nd.  we set up a site through CaringBridge for friends to follow her progress.  This is the simplest way for me so I am only writing once a day (usually) rather than telling the same story over and over.

RAYMOND CARTER, FORMER DEALER AND PAST CADA CHAIR, PASSES AWAY

Raymond L. Carter, 70, Denver, CO died peacefully of Leukemia at home with his family on July 13, 2010. Survived by his immediate family, Sharon Carter, Darren Carter, Kimberly Carter, and Fallon Carter; his sister, Janis Sheeley, and granddaughter, Elizabeth Carter. After spending nearly 25 years as a car dealer in Southwest Colorado he retired and returned to Denver to play golf and cards with his best friends at the club.
