The Member Services Committee undertakes a lengthy review process to make endorsement recommendations that are then approved by the CADA Board of Directors:
1. Obtain recommendations from members, contact dealer associations in other states, and do other searches
2. Invite all to respond to an initial questionnaire
3. Invite selected companies to interview/present in-person, by phone and/or via online presentation
4. Work through a due diligence process to check recommendations, compare pricing proposals, review product/service offerings, and obtain the best discounts possible for CADA Members—all reviewed based on specific selection criteria
5. Engage in contract negotiations for the best terms and price possible

OPEN HOUSES TO INTRODUCE AIR CARE COLORADO VEHICLE EMISSIONS TESTING PROGRAM
Beginning this November, most gasoline-powered vehicles registered in parts of Weld and Larimer Counties will be required to pass an emissions inspection prior to registration renewal.
Area residents are invited to attend Community Open Houses over the next few weeks. The purpose of the events is to provide information and answer questions about the upcoming expansion of the Air Care Colorado vehicle emissions testing program to parts of Weld and Larimer Counties this fall. . . .

RISK BASED PRICING NOTICES TO CONSUMERS - NEW FEDERAL MANDATE AFFECTING DEALERS STARTS JANUARY 1, 2011
As most dealerships are likely aware by now, a new federal notice requirement by the FTC goes into effect the first of next year. With just over a few months left in this year, it is time for dealerships to begin to plan for the implementation of this new requirement. An overview of this latest federal mandate is below:
- The new notice requirement is intended to complement the already existing Adverse Action notice requirement that has applied for some time now. The Adverse Action notice is required whenever creditors (dealers included) deny a consumer credit based on information in his/her credit report.
- Generally, this latest rule requires a new notice to consumers to whom the dealer will extend credit “on material terms that are materially less favorable than the most favorable terms available to a substantial portion of consumers from or through that person.”
- HOWEVER, because that requirement is so complex to apply in practice, NADA argued for, and was able to obtain an EXCEPTION notice. Because it removes the complexity of applying the vague terms above, it is expected that most dealers will utilize this Exception notice form.
- The one, big downside is the Exception notice must be issued to all consumers who request credit (seems an easy trade-off with trying to implement the preceding provision).
- In order to use the Exception notice, the notice must include the consumer’s credit score along with other specific information.
- There is an Alternative Exception Notice for instances where the consumer’s credit score is not available.

- Dealers that engage in the typical third-party financing transaction (whereby the dealers utilizes the consumer’s credit report to help identify likely finance sources to whom the contract will later be assigned) were specifically included and named in the final regulations so, unfortunately, there is no question that the new mandate applies to most dealers.
Dealerships should begin to plan now to ensure someone is trained on the full details of this new notice requirement, and that it can be implemented by January 1, 2011.
CADA will be providing training on this new notice requirement the third week of November. Dates, times and specific locations will be coming soon!

On "why are you here?": When I was working with my dad, I was the second woman to go to the General Motors' Dealers' Son School in Flint, Mich. That's what they called it. It was a six-month program, and there were about 220 of us in the class. When I entered the classroom, the instructor looked at me and said the warranty clerk's class was down the hall. I told him I was not there for the warranty clerk's class, and he asked, "What do you need, honey?" I said, "I'm here to be a dealer — what are you doing here?" The first week was stressful, but when he saw that I was serious, we seemed to get through it.

GRAND OPENING OF THE MURRAY MOTOR IMPORTS
September 9, 2010, Murray Mercedes-Benz of Denver opened the doors to their new sales center with a Ribbon Cutting Ceremony. Present were Mark Murray (Owner), Todd Bondy (General Manager), Scott Fischer (Mercedes-Benz Representative), Larry Harte (Glendale, CO Mayor), Bud Wells (Denver Post) and Tim Jackson (CADA). After the ceremony, there was a catered BBQ with plenty of great food and great company! And it gave everyone a chance to check out the new Sales Center, and all the great cars that Mercedes-Benz has to offer.
