DAMAGE DISCLOSURE REMINDER
Re-run from Open Road, 9/10/2008
This is to remind you of the following applicable statutes and regulations that cover the issue of prior damage disclosure.
We frequently receive calls about damage disclosure requirements.
While some states do have specific monetary damage limits above which any prior damage to a car must be disclosed to the consumer, Colorado does not. Generally in Colorado, the governing statutes and regulations require disclosure of damage that is “MATERIAL.” This is a vague term, and because ‘material’ generally is interpreted in light of each, particular customer, CADA’s business advice is to disclose ALL prior damage of which the dealership has knowledge. Some attorneys have also suggested taking photograph(s) of the damage and keeping a copy of the photo in the deal jacket.

CADA LEGISLATIVE POLICY COMMITTEE DEALER MEETINGS
The CADA Legislative Policy Committee is scheduling dealer meetings with Colorado state legislators in order to increase awareness and gain support for the many policy issues expected to face auto dealers in the upcoming session of the Colorado General Assembly which convenes January 12, 2011.
Several meetings are planned and you are invited to participate in as many of the meetings as you are able to do.
The primary purpose of this series of brief get-togethers is to foster and advance relationships between CADA member dealers and Colorado’s elected leaders.
The following topics areas are expected to be covered in each session:
- Auto industry issues in general
- Colorado dealer issues in particular
- Proposals to repeal Colorado’s ban on Sunday sales of automobiles
- Growing class action litigation against the auto retail industry
- Trends in auto sales in state and nationally
- Sales tax jurisdictional issues
With the economic challenges faced by the industry today, it is more important than ever that state legislators get the opportunity to hear from you on issues of importance to you and your business.

PARKER: AUTO DEALER HITCHES WAGON TO TEBOW
Groove auto-dealership president and CEO Rod Buscher and Broncos backup quarterback Tim Tebow will announce today a partnership between their respective foundations.
But the far-reaching benefits for the auto group will likely go well beyond the foundations' partnerships.
Buscher, who with No. 7 formed the successful John Elway dealership group in 1989, sold to what would become Auto Nation in 1998.

GENE OSBORN PASSES AWAY
Gene Osborn 73, of Lakewood. Longtime Denver area business man/auto dealer. Passed away Sept. 22, 2010. Born in Chickasha, OK. Survived by his wife of 50 years - Rosemarie, son - Jimmy, daughter - Gena (Gary), grandchildren - Christopher and Abby, sister - Reta, and brother - Jim R. Mass of Christian Burial, Tuesday, Oct. 5, 2010, 10:30 a.m., Our Lady of Fatima Catholic Church, 1985 Miller St., Lakewood. In lieu of flowers donations will be sent to The Truth - an anti-smoking education organization. Donations may be sent to Larry H. Miller VW in care of Diane, 8303 W. Colfax Ave., Lakewood, CO 80214.
