MODEL PRIVACY NOTICE: NEW AGENCY-PROVIDED FORMS OFFER SAFE HARBOR
Dealers need to switch-over by December 31, 2010
As a reminder, the FTC and federal banking agencies now have a model privacy notice that dealers can utilize to describe their privacy policies to finance and lease customers. Utilizing these new model notices, consistent with instructions, provides “safe harbor” protection. Dealerships could begin taking advantage of that safe harbor as of December 31, 2009, and have until December 31, 2010 before the safe harbor under the old, sample language expires.
Those still utilizing the prior, sample language will lose safe harbor as of December 31, 2010.
Below is a link to a ‘form builder’ that the FTC produced to assist dealers with the model privacy notices.

ELECTION 2010 REPORT FOR THE COLORADO AUTOMOBILE DEALERS ASSOCIATION
Prepared by Melissa L. Kuipers, Esq., Vice President of Government Relations and Communications, November 11, 2010
CADA Achieves 96% Accuracy Rate in predicting Colorado House and Senate Races
Election Night 2010 was nothing short of thrilling. The CADA Legislative team was awake until the wee hours of the morning after election night watching recounts in several key races in Colorado. The Colorado Automobile Dealers Association Political Action Committee (PAC) contributed to candidates in 74 Colorado House and Senate Races. Of those candidates to whom CADA provided financial support, 96% were victorious.
Comparatively at the national level, NADA’s Dealer Election Action Committee (DEAC) provided financial contributions to a total of 7 Federal candidates for the US Senate and US House of Representatives. Of those candidates to whom DEAC provided financial support, 71% were victorious (5 out of 7).
The business community as a whole received a large boost Election Night when the Republicans gained control of the Colorado House of Representatives. The Republicans picked up 6 seats which were previously held by Democrats in order to take the majority. These key races are listed later in this report.
