OFFERING TO PAY CONSUMER SALES/USE TAXES NOT ALLOWED IN COLORADO

Several retailers have recently been offering on radio and other advertisements to pay for or refund consumers’ sales taxes.  A reminder to all dealers that there is a general prohibition in Colorado covering all retailers from offering to “assume” or “absorb” state sales/use taxes.  Offering a “refund” is similarly disallowed.

The statute is below:

39-26-108. Tax cannot be absorbed.
It is unlawful for any retailer to advertise or hold out or state to the public or to any customer, directly or indirectly, that the tax or any part thereof imposed by this part 1 will be assumed or absorbed by the retailer or that it will not be added to the selling price of the property sold or if added that it or any part thereof will be refunded. Any person violating any of the provisions of sections 39-26-105 to 39-26-113 is guilty of a misdemeanor.
[C.R.S. 39-26-204(3) contains a similar provision applicable to use tax]

IRS CREATES UNICAP SAFE HARBOR METHODS FOR DEALERS
NADA Advocacy Leads to Major Victory for Dealers

In a major victory for car and truck dealers, the IRS has created uniform capitalization (UNICAP) "safe harbor" methods of accounting that favorably resolve several contentious and potentially very costly income tax issues that have arisen during IRS audits of franchised dealers over the past five years.

The new safe harbor methods, which the IRS issued following numerous meetings with NADA, generally allow car and truck dealers to be classified as retailers who are not required to capitalize handling, storage, or production costs incurred at their retail sales facilities.
