NADA OUTLINES JOB-KILLING REGULATIONS IN LETTER TO NEW CONGRESS
Call for Dealers to Cite Examples and Impact of Regulatory Burdens

With the opening of the 112th Congress last month, NADA highlighted some of the undue regulatory burdens dealers face that have hindered job creation in a letter to incoming House Oversight and Investigations Committee Chairman Darrell Issa, R-Calif. The letter addresses several pending issues of concern to auto retailers and points out how the cumulative effect of the staggering number of federal rules has impaired dealers’ ability to grow their businesses and expand their workforce.

The letter addresses fuel economy/greenhouse gas (GHG) rules, rules adopted by the National Highway Traffic Safety Administration (NHTSA) and the Environmental Protection Agency (EPA), as well as credit-related regulations, such as the Red Flags and Risk Based Pricing Notice rules, which make granting credit more costly and burdensome without providing a substantial benefit for car-buyers.

Dealers with additional examples of excessive regulatory overreach should send their comments to NADA at regulatoryaffairs@nada.org. Rep. Issa has also set up a Web site at www.AmericanJobCreators.com where business owners can fill out a form detailing how the federal governmental impacts business.

DEPARTMENT OF LABOR'S BRIDGE TO JUSTICE PROGRAM
From Mountain States Employers Council Hot Topics (January 2011)

Despite adding 350 new investigators to its staff in the last two years, the US Department of Labor (DOL) still cannot keep up with the large number of complaints it receives.  As of December 13, 2010, the DOL’s Wage and Hour Division, in collaboration with the American Bar Association Standing Committee on Lawyer Referral and Information Service, will now connect workers to local referral services that will provide them access to attorneys to help them with their claims against their employers.

According to the DOL, this collaboration will provide workers a better opportunity to seek redress for Fair Labor Standards Act (FLSA) and Family and Medical Leave Act (FMLA) violations.

The program may increase overtime and minimum wage litigation against employers by assisting workers who would otherwise not have pursued claims.  Also, because the DOL will be using a new process to share information and documents with these referral attorneys, it is important to carefully monitor information provided to the DOL.  Please consult with MSEC if you receive a request from the DOL.

Claims under the FSLA and the FMLA do not require exhaustion of administrative remedies as do discrimination charges; therefore, workers can pursue private litigation under these laws.

The Colorado Department of Revenue offers a three-hour business tax class regarding the laws surrounding state sales and use taxes applicable to businesses conducting sales in Colorado. Topics covered in this class include:

  • overview of sales/use tax liabilities
  • state sales tax licenses
  • working with tax-exempt transactions
  • sales/use tax collection for state-collected jurisdictions
  • general guidelines for filing sales/use tax returns
  • available resources/electronic services
