CADA IS PLEASED TO INTRODUCE POLLY PENNA AS OUR NEW FIELD SERVICES DIRECTOR!

 After discussions of the Member Services Committee and extensive evaluation, there was overwhelming consensus to expand what was formerly an F&I specific role to one that includes representation of all products, services and resources that are available from CADA.  Polly will be available to serve as a direct point of contact to connect members with all of the services CADA offers—even if in some cases that simply involves connecting you with the right staff person at CADA, with an endorsed provider, or with any other resource you may need. 

Polly brings nearly 25 years of experience in both the retail and tier one sectors of the automotive industry – most notably in regional business development management, brand-specific marketing, and finance.  She previously worked with a CADA allied member, selling CRM solutions to Colorado dealerships as well as other Western states.   With her depth of automotive experience and existing knowledge of the Colorado franchised dealership industry, Polly is a welcome asset, and will be working hard to help serve and assist all CADA members!

DEALER ACTION ALERT: DEALERS MUST OBTAIN OFF-PREMISE PERMITS BEFORE THE START OF THE AUTO SHOW

This is to remind all member dealers who intend to engage in any sales activity* at the Denver Auto Show—which runs March 30th through April 3rd this year—that an off- premise permit must be obtained BEFORE the start of the show.

*Sales Activity: Generally, an off-site permit is required when sales activity is taking place off-site, not for the mere display-only of vehicles. While the topic of what exactly constitutes “sales” is a somewhat gray area, CADA encourages dealers to err on the side of caution. Typically, “sales activity” is deemed to include test drives or any discussions with a consumer regarding price, financing, and/or related aspects of an actual deal that extend beyond discussing the vehicle attributes and features. That is the guidance that has been provided at the Denver International Auto Show in the past regarding “sales activity” in reference to Sunday sales.

ABOVEGROUND STORAGE TANKS - STATE REGULATIONS AND RECENT ENFORCEMENT

A number of dealerships have inquired about enforcement notices they have received from the Colorado Division of Oil and Public Safety (OPS) of the Department of Labor & Employment. 

Background:
Last year there was increased regulatory pressure regarding petroleum (Aboveground Storage Tank) ASTs. Historically, regulators were mainly concerned with leaking from Underground Storage Tanks (USTs) and in particular, fuel USTs. Further, while there have been laws and regulations regarding ASTs for quite some time, the primary enforcement concern for ASTs had been on large fuel tank farms and/or refineries with very large crude/refined petroleum storage tanks.  Gradually, with the correction of many deficiencies and upgrades regarding USTs and larger ASTs, EPA and the state have turned a closer eye to all ASTs, whether fuel or lubricating oils, used oil, etc.  Furthermore, Colorado AST rules are currently more stringent than the Federal AST rules.  

Key state requirements:
In brief, the key requirements below currently apply under state regulations for ASTs:

  1. Registration.  All petroleum ASTs with a capacity of 660 gallons or more and less than 39,999 gallons must be registered with OPS. The annual registration fee is $35.00 per tank.
    1. Note that waste-oil burners are the likeliest tanks to be over the 660 threshold. 
  2. Ullage logs.  The state also requires that any tank within the capacity above must be monitored using an approved Ullage log form to record the amount of storage capacity available in the tank on a recurring basis. The purpose is to ensure that tanks are not overfilled beyond capacity.
    1. For used oil tanks this “sticking of the tank” must be done twice a day and the Ullage volume calculated and recorded each time. A tank gauge may be used to determine the available capacity in the tank, but this information must still be documented.
    2. For all other oil tanks this “sticking of the tank” occurs just before a delivery is made and Ullage volume calculated and recorded each time.
  3. Monthly Inspection.  Furthermore, the state also mandates that a monthly inspection of the tank(s) is conducted using an approved log to ensure the tank is visibly structurally sound, not leaking and in good functional condition, visually.  This inspection can be completed by dealership personnel.
