EMISSION TESTING VOUCHERS: COST CAN BE PASSED ALONG TO CONSUMERS

Question:            Are dealerships able to pass along to consumers the $25.00 charge for the emission testing vouchers that must be provided?

Answer:            YES.  The relevant statute, C.R.S. 42-4-309, specifically allows for the voucher to be provided “with or without charge to the consumer, up to the maximum amount charged for an emissions inspection at an enhanced inspection center.”

MISLEADING STATE CORPORATE FILING SOLICITATION: 'CORPORATE CONTROLLERS UNIT'

Colorado Secretary of State Scott Gessler has issued an alert to Colorado businesses of a deceptive solicitation issued by an entity called the "Corporate Controllers Unit." CLICK HERE for the full alert. 

The entity has mailed solicitations titled "Periodic Report" to businesses in Colorado. These solicitations offer to process periodic reports with the Secretary of State's office on behalf of entities for a $225.00 fee. Though the majority of entities doing business in Colorado are required to file periodic reports with the Secretary of State's office, the filing can be completed directly with the Secretary of State's office and in most cases the fee is merely $10.00. 

Although the solicitations contain disclaimers stating that "This product or service has not been approved or endorsed by any Government Agency and this offer is not being made by an agency of the Government," the solicitation is creating confusion. Please be aware, the forms are not required by the Colorado Secretary of State's Office.

HOUSE BILL 1185

The Colorado Senate passed House Bill 1185 on a unanimous vote during the bill’s Third and Final Reading in the Senate Chamber.

The bill now returns to the House of Representatives where a vote a concurrance with Senate Amendments is expected.

House Bill 1185 requires lenders to release the title within 15-days upon payoff by owner or dealer after trade-in.  The Senate amedned the bill to allow for exceptions in cases of natural disasters such as earthquakes, fires power outages, etc…  While there are no specific penalties included in the measure it does establish to provisions under which lenders should act and therefore, in cases of frequent abuse

HOUSE BILL 1188

The CADA franchise act improvement bill, HB-1188, is advancing in the Colorado Senate.  The Senate Business Labor and Technology (BLT) Committee heard the bill during a committee hearing last Tuesday and laid the bill over for amendments to be considered.  In a meeting at the Capitol on Thursday with manufacturers and CADA, no agreement was reached on amendments and the final outcome of the bill was left in question.  A vote on HB-1188 in the BLT committee is expected within the next few days.
