AUTO INDUSTRY NEWS AT A GLANCE

Listed here are several articles pertaining to the
auto industry in general that appeared recently in newspapers and other media outlets across the nation.

…more news articles are included at the end of this issue.

SALESPERSON EXAM ADMINISTRATION: UNLAWFUL TO GIVE OUT PASSWORD AND EXAM MUST BE 'ADMINISTERED'
**Recent dealership violations highlighted to the Dealer Board**

Recently, the Auto Industry Division reported to the Motor Vehicle Dealer Board that some dealerships have been providing the administrative password for the online salesperson exam to test-takers.  In one instance, the password was provided to some individuals employed by out of state event companies about to come to Colorado for off-site sales.   The Division views these as very serious violations.  Before levying more serious fines or penalties against dealerships, the Board has requested that the Division and the dealer associations communicate very clearly the obligations and restrictions of serving as an approved exam administrator:

  1. The exam must be taken on line (the prior, paper exam is not allowed and is not valid; except in special circumstances, for which approval must be obtained in advance)

  2. The exam affidavit form DR2097(updated, Rev. 4/28/2011) is signed by both the salesperson applicant AND a representative of the dealership.  It is important to be familiar with the affirmations being made:

    a. It is signed under penalty of perjury by both parties

    b. It affirms that the exam was successfully completed and “administered” at the     dealership
            i. NOTE that results of every exam attempted are sent directly to the Division            via email immediately upon completion, and include a time-stamp, if a test            was taken at midnight, it was probably not completed at the dealership
ii. ‘Administered’ means there was some oversight to ensure the test was            taken independently and without assistance

    c. It affirms that the salesperson completed the exam “without assistance

Dealers and salespersons should take the examination obligations and affirmations very seriously.  Perjury is a serious offense, and as a violation of the dealer board regulations, both the dealership and the salesperson are subject to significant fines and penalties.

CADA provides salesperson exam administration for NO CHARGE.
As an approved third-party administrator, CADA also provides salesperson exam administration and oversight.  If proper oversight and administration of this licensing examination is not possible due to space or staffing limitations, send any test-takers to the CADA office.   Call 303.831.1722 to schedule a time if possible, but walk-ins are welcome

ROBERT DAVID HAJEK, 74, OF LONGMONT, PASSES AWAY

Bob was born March 14, 1937 in Detroit, Michigan the only son of Oscar D. and Rose (Steckel) Hajek. The family moved to Longmont in 1951 and Bob went on to attend and graduate from Longmont High School, where he was on the football team, which won state championships in 1954 and 1955. He later graduated from Colorado State University. After graduation from college, Bob joined the Coast Guard Reserve and served his country as a “weekend warrior” for the next 7 years.

In 1961, Bob joined his father operating the Hajek Chevrolet/Olds dealership. When Oscar passed away in 1967, Bob was granted the opportunity to own the dealership, making him the youngest dealer in the nation at that time. Bob loved cars and thoroughly enjoyed his career. He was definitely a “hands on” owner and you could always find him on the showroom floor. He doted on his employees and customers alike. His children worked in the business from an early age and he was excited to have his sons join him in taking over the day to day operations during the past year.
