SALESPERSON LICENSING: NEW APPLICANTS NOT LICENSED UNTIL ISSUED BY THE STATE

A recent dealer question raised the issue about the timing of when a NEW salesperson applicant is able to engage in sales activity.  Note that temporary licenses are currently only being issued to salespersons when they are processed in-person at the state dealer counter; and even then the ability to obtain a temporary may depend on any items that surface in the initial background check. Otherwise, the process to obtain a new salesperson license will typically take anywhere between two weeks to a month, but can take longer depending on the investigation needed and if anything is missing or incomplete on the original application.  If the application is incomplete or missing documentation the entire packet is mailed back with a reject letter explaining the issues.  If an application is taking longer than thirty days, and you are not yet working with anyone specific at the Auto Industry Division, send an email to dealers@spike.dor.state.co.us to check on status (please also cc: the Division Director, Bruce Zulauf at bzulauf@dor.state.co.us).  

Once issued, the permanent license is mailed to the dealership.  It is important for dealers and salespersons to be aware that the salesperson cannot engage in sales activity until either a permanent or temporary license has been issued by the Division.  It is a violation for both the salesperson and the dealer if a salesperson engages in unlicensed sales at the dealership.

Note that once a license is issued, it will be reflected immediately in the state IDS (Integrated Data System); dealers awaiting a particular license can also check there:

The IDS system provides for lookup by salesperson or by dealership to check salesperson license status (this is the same system that accesses the state tax rate lookup database).  This database appears in the drop down menu after you sign into IDS at http://ids.dor.state.co.us  as “Inquiry Auto Industry Salesperson”. To register for the IDS program, go to that same URL and sign up using the “New User” option.

New state licensing system coming later this year.  The Division is currently revamping many of their licensing forms and procedures in advance of the move to a new license computer system that is currently in use in other state departments.  It is expected the new system will streamline various aspects of the licensing process.

EMPLOYMENT SEMINAR: OVERTIME EXEMPTION RULE CHANGE NOW IN EFFECT
Department of Labor reverses longstanding position on dealership service personnel.


Are “service writers, service advisors, service managers, and service salesmen” exempt from overtime?


For at least 32 years, the U.S. Department of Labor (DOL) has advised car and truck dealers and its own staff that the answer, unequivocally, was yes. In addition, a uniform and uncontroverted line of federal court cases dating back to 1973 has held likewise. However, in April 2011, U.S. Department of Labor published a Final Rule stating that service writers should not be considered exempt from overtime.

Highlights of topics included:
Historical perspective on exemption of service writers and what the 2011 final rule means. What should you as a dealer employer do? This seminar will cover employer options to keep service writers exempt from overtime.
