NATIONAL LABOR RELATIONS BOARD (NLRB): NEW POSTER MANDATE AND MORE PRO-UNION CHANGES ON THE HORIZON

National Labor Relations Board Now Requires Posting Of Employee Rights

On August 25, 2011, over the dissent of Member Brian Hayes, the National Labor Relations Board issued a final rule addressing "Notification of Employee Rights under the National Labor Relations Act." Effective 75 days following the August 26, 2011 scheduled publication in the Federal Register, which would be November 9, or November 14 (per the NLRB's inconsistent press release), every employer covered by the National Labor Relations Act will be required to post the prescribed 11x17 inch notice.

In addition to physical posting at "conspicuous places…readily seen by employees, including all places where notices to employees…are customarily posted," any employer that "customarily communicates" via intranet or internet with its employees as to "personnel rules or policies" must display an exact copy of the Notice on such site(s), or a link to the NLRB's web site which reads, "Employee Rights under the National Labor Relations Act."

The new Rule isn't just about unionizing and organizational rights (although it certainly is designed to promote that outcome). In addition to a rather one-sided statement of protections afforded to employees who are or who may wish to be engaged in organizing activities, the Notice speaks to protected concerted activities, alerting employees to protections they have in voicing complaints about terms and conditions of employment.

Proposed Changes to Union Election Procedures

NADA submitted comments to the National Labor Relations Board (NLRB) on proposed changes to union election procedures.  Overall, the proposal “would severely compact the time employers presently have to communicate with employees on potential union organizing activities” and  “would undermine the rights of employers.”  As NADA points out, under the current process, organized labor wins elections over 67 percent of the time.  The docket currently includes over 21,000 comments, a majority of them against changing the election procedures.

EMPLOYMENT SEMINAR: OVERTIME EXEMPTION RULE CHANGE NOW IN EFFECT
Department of Labor reverses longstanding position on dealership service personnel.


Are “service writers, service advisors, service managers, and service salesmen” exempt from overtime?


For at least 32 years, the U.S. Department of Labor (DOL) has advised car and truck dealers and its own staff that the answer, unequivocally, was yes. In addition, a uniform and uncontroverted line of federal court cases dating back to 1973 has held likewise. However, in April 2011, U.S. Department of Labor published a Final Rule stating that service writers should not be considered exempt from overtime.

Historical perspective on exemption of service writers and what the 2011 final rule means. What should you as a dealer employer do? This seminar will cover employer options to keep service writers exempt from overtime.

STEVINSON AUTOMOTIVE ANNOUNCES THE ACQUISITION OF LONGS PEAK HYUNDIA

August 25, 2011 -- Stevinson Automotive, a Lakewood-based corporation specializing in automotive sales and service today announced the acquisition of Longs Peak Hyundai in Longmont, Colorado. The new dealership, Stevinson Hyundai of Longmont, brings Stevinson’s family of auto dealers to seven in the Front Range area.

LISA SCHOMP STEERS CLEAR OF AUTO INDUSTRY POTHOLES

When Lisa Schomp walked into her first day at the GM Institutes’ Dealer Sons School in 1976, the instructor called her “honey” and told her the warranty clerks’ class was down the hall.

Schomp, owner and president of Schomp Automotive, replied that she wasn’t there for the warranty clerks’ class, but for the Dealer Sons School.

“I mean, you could have heard a pin drop — you could hear their hair growing,” Schomp said.

Schomp was the second woman to graduate from the Dealer Sons School. She said her experience at the school “spoke deeply” of how it felt to be a woman in the male-dominated world of retail auto sales.

From childhood, Schomp told her father, Ralph Schomp, that she wanted to sell cars for a living, as he did.

MADELYNE FISHER PASSES AWAY

Madelyne Fisher passed away Friday, July 29th, 2011 at Sunrise Assisted Living of Boulder.

Madelyne was born in Denver, CO. to Alphonse Keating and Catherine Keating. Madelyne attended schools in Englewood, CO. She married her high school sweetheart, Robert (Bob) Fisher in 1945 when he returned after serving in the South Pacific in the U.S. Navy. 

aLike many veterans at the end of WWII, Bob and Madelyne needed to find a job, and at Madelyne's suggestion he went into selling automobiles in Englewood,CO. He took her advice, and before long the couple shared a dream of owning their own Automobile Dealership. 

Madelyne and Bob had two children Lynn Rickman, and R. Craig Fisher. Madelyne and Bob were active in the Englewood, CO. and Littleton, CO. community, while Bob worked at Burt Chevrolet and raising their children in the Littleton School District. 

In 1968 Bob and Madelyne attained their goal of becoming partners in Russ Lyons Chevrolet in Boulder, they eventually purchased the Chevrolet franchise from Russ Lyons in 1973. Together they moved the franchise and dealership to 33rd and Arapahoe and then to Cherryvale and Arapahoe. They acquired Honda and became "Fisher Chevrolet, & Fisher Honda. The dealership is now Fisher Honda and KIA, and is now owned by R. Craig Fisher and Lynn Rickman.
