KPA AND SIEGEL OIL COMPANY ANNOUNCE PARTNERSHIP

Lafayette, CO (KPA, September 27, 2011) – KPA , provider of human resources, environmental, health, and safety software and services, and Siegel Oil Company announced an exclusive marketing agreement, endorsing each other’s products and services to Colorado automotive dealership.

With the average dealership writing checks to forty vendors every month, a little consolidation is a welcome relief. With this in mind, KPA and Siegel Oil announce a new partnership that will bring diverse services and products to automotive clients in Colorado, without the extra paperwork.

TAKE-AWAYS FROM RECENT KPA WEBINAR ON ENVIRONMENTAL, HEALTH & SAFETY ENFORCEMENT

In a recent KPA webinar, some eye-opening information was provided regarding the enforcement activity level of key federal regulatory agencies.  In an August 15, 2011 Investors.com article, the following facts were noted:

  • Regulatory agency’s combined budgets increased 16% since 2008
  • Agency employment has climbed 13%

Labor Secretary Labor Secretary, Hilda Solis stated in Jan. 2010:
  “OSHA received over 100 inspectors in our 2010 budget, as well as an additional 25 requested in 2011.  We are also moving 35 inspectors from compliance assistance activities to enforcement….There’s a new Sheriff in town.”

Regarding the sheer volume of new regulations:

  • Federal Register total # of pages increased 18% in 2010
  • 379 new rules were passed in July
  • Federal Register – 4,200 new proposed rules on the way!

On the potential fines and penalties:

  • OSHA, up to $70,000 for “willful” (can mean ‘indifference’) or repeated violations; average penalty per serious violation has almost doubled between 2010 and 2011.  “Good Faith” reductions only if a safety and health program in place.
  • DOT raised maximum civil penalty from $32,500 to $50,000 in 2006; then to $55,000 in 2010; $110,000 if results in death, severe injury, or significant property damage.  Further, for continuing violations, each DAY is a separate violation.
  • EPA penalties typically up to $37,500 per incident per violation.
