COLORADO LEGISLATOR MEETINGS, 2011

Dealers:

The CADA Legislative Policy Committee is scheduling dealer meetings with Colorado state legislators in order to increase awareness and gain support for many policy issues expected to face auto dealers in the upcoming session of the Colorado General Assembly which convenes January 11, 2012.

Several meetings are planned and you are invited to participate in as many of the meetings as you are able to do.

The primary purpose of this series of brief get-togethers is to foster and advance relationships between CADA member dealers and Colorado’s elected leaders.

The following topics areas are expected to be covered in each session:

  • Auto industry issues in general
  • Colorado dealer issues in particular
  • Proposals to repeal Colorado’s ban on Sunday sales of automobiles
  • Growing class action litigation against the auto retail industry
  • Trends in auto sales in state and nationally
  • Sales tax issues for dealer license plates and jurisdictional tax issues

With the economic challenges faced by the industry today, it is more important than ever that state legislators get the opportunity to hear from you on issues of importance to you and your business.

ADVERTISING VIOLATIONS & COMPLIANCE ISSUES RELATED TO TRUECAR/ZAG
Dec. 16, 2011 CADA Memo

At the regularly scheduled meeting of the Colorado Motor Vehicle Dealer Board on December 8, 2011, Bruce Zulauf, Auto Industry Division Director and Executive Secretary to the Board, and investigative staff briefed the Board on the activities of a company known as TrueCar that is operating in Colorado. The following reflects the discussion by and direction of the Board.  [A similar statement is available in a December 15th statement posted by the Auto Industry Division.]

It has come to the attention of the Colorado Motor Vehicle Dealer Board (“Board”) and the Auto Industry Division (“Division”) that a number of new motor vehicle dealers have relationships with a company known as TrueCar. The Division has identified a number of advertising violations in TrueCar materials and on its web site, as well as other potential violations of the Motor Vehicle Dealer Act (“Act”) and related regulations. Any Colorado licensed dealer that is using TrueCar to promote and list its vehicles to consumers is ultimately responsible for any such violations. The specific advertising violations identified are:

  • Failure to include stock number of the vehicle for sale (violates Advertising Rule 3)
  • Use of the word “invoice” in the advertising (violates Advertising Rule 11)
  • Font size of disclaimers is too small (violates Advertising Rule 15)
  • Failure to advertise price of vehicle including all costs including Delivery & Handling (violates Advertising Rule 13)
    ‐ TrueCar disclaimers also refer to a “Documentation fee” which is terminology that
    has led to lawsuits in Colorado in the past
  • No expiration date or time limit for offer which could possibly result in a motor vehicle being listed for sale but no longer in inventory (violates Rule 3)

SALES/USE TAX CHANGES EFFECTIVE JANUARY 1, 2012

The state tax division posts upcoming sales and use tax changes each January 1st and July 1st.  Dealerships should be aware of these changes and be on the lookout to ensure the tax database being utilized reflects these changes.  There may be a time-lag between the effective date and the update of these data sources.  Keep in mind, that all self-collected jurisdictions must report and changes are effective on these two dates each year.  Home-rule jurisdictions, however, can change at any time, and while many still adhere to these timeframes and report to the state, in the past, their changes have not always shown up in this list.

REMINDER: FOOTBALL STADIUM DISTRICT SALES TAX EXPIRES DEC. 31

Beginning January 1, taxpayers will no longer pay the one-tenth of one percent Football District sales/use tax in the Denver area. The Metropolitan Football Stadium District (FD) tax will end on December 31, 2011 as planned in the law that established the tax.
