NLRB FURTHER DELAYS POSTING REQUIREMENT DEADLINE, BUT ISSUES REGULATION THAT SPEEDS UNION ELECTION PROCEDURES
NADA Supports Legal Challenges to Both Rulemakings
The National Labor Relations Board (NLRB) has further postponed, now until April 30, 2012, the requirement that its new employee rights poster be prominently displayed in union and non-union workplaces. The former deadline was January 31, 2012. The purpose of the delay is to facilitate resolution of legal challenges to NLRB's authority to impose the mandatory posting requirement. All dealerships are required to display this poster by the implementation date. The rule has been challenged in federal courts in the District of Columbia and in South Carolina. NADA is involved in the lawsuit in the District of Columbia through its membership in the Coalition for a Democratic Workplace (CDW). The NLRB has also released its final rule radically changing the union election procedures for union representation elections. The new rule shortens election time frames, greatly limiting employees’ opportunities to hear from employers in order to make an informed choice on unionization. A fact sheet on the changes is available here. NADA submitted comments opposing these changes earlier this year, but the NLRB fast-tracked a reduced version of the amendments without taking further stakeholder input. Through its membership in the CDW coalition, NADA is involved in a lawsuit in federal court to block these changes as well. A copy of the complaint in that case is available here.

REMINDER: 8300 CASH REPORTING - CONSUMER NOTICES DUE BY JAN. 31ST
Generally, any business that receives more than $10,000 in cash in a single transaction or related transactions must complete a Form 8300, Report of Cash Payments Over $10,000 Received in a Trade or Business.
Additionally, businesses must notify customers that it has filed a Form 8300 regarding their cash transaction(s) -- in writing, by January 31 of the subsequent calendar year.

KUNI BUYS FIVE DEALERSHIPS IN ITS BIGGEST DEAL EVER

Kuni Automotive has bought two metro Denver Land Rover dealerships in a deal that includes five stores from the Pioneer Centres Holding Co. Inc.
It’s Kuni’s largest purchase ever, according to the Vancouver, Wash.-based company, and increases its size to 14 dealerships in four states. Kuni now has more than 1,000 employees.
“Obviously this type of acquisition says we’re optimistic about the future,” said CEO Greg Goodwin. He started with the company in 1991 when he and founder Wayne Kuni bought the Lexus dealership at 6160 S. Broadway that’s now Kuni Lexus of Littleton.
