LABOR DEPARTMENT - UNEMPLOYMENT INSURANCE UPDATES
From UI Quarterly News, 4th Quarter 2011
The Colorado Department of Labor and Employment, Unemployment Insurance (UI) Program provided some key reminders and updates to employers in their latest newsletter. Typically, these changes are provided directly to employers in account statements and other communications. However, some highlights to bring to your attention are noted below:
- Due Dates – Change from Postmarked to Date Received. A change in regulation means that in order for reports and payments to be timely, ***they must be RECEIVED at the UI office on the date due***. A postmark by that date is no longer sufficient.
- 2012 Rates: The base rate for most employers remains the same. 2012 rates were provided on Unemployment Insurance Rate Notice forms mailed in November. Begin using the 2012 assigned rate with the first quarter 2012 reports due on April 30, 2012. Rates were mailed to each account; if you did not receive this notice, contact the UI office directly – they will need to provide to you directly as specific rates vary by account. 303.318.9100 (Denver-metro area) or 1.800.480.8299 (outside Denver-metro area).
- Independent Contractors: The first item highlighted covers ongoing focus on misclassification of employees as independent contractors. Misclassifying employees as contractors can result in UI back-premiums plus interest.
Employers can also seek advisory opinions if unsure—existing law requires the UI program to provide an opinion when one is requested. CLICK HERE for further information on that process.

The alert also explains the availability of extensive educational resources on this and other regulatory compliance topics at: www.nadauniversity.com and www.nada.org/regulatoryaffairs.
