TITLE PROCESSING: SIGNATURE/DATING ISSUE ON SECURE POA FORM, DR 2174—SPECIAL PROCESS ALLOWED FOR EXISTING PAPERWORK

A Nov. 22, 2011 article, Signature/Dating Issue On Secure POA Form, provided an alert regarding new scrutiny being applied by county and state title processing departments on the timing/dating of this form.  At that time, notice was provided that "The state has not yet issued guidance or exceptions for paperwork already in progress. We will provide an update when further information is provided.”  Requests were made at that time for some grace period or exception process given that many dealerships had been doing this incorrectly, and neither counties nor the state had ever rejected based on this date-field.

In January, CADA began receiving complaints of rejections in a few counties for paperwork utilizing POAs that been signed right around the time of the original state notice, with no allowance for DMS system programming changes or that many of those trade-ins simply may not be sold until much later.  The state Titles and Registration indicated a willingness to review various options, but wanted some indication of the scope of the volume of affected paperwork.   CADA sent an urgent alert to the CADA Title Processing Distribution email list.*  Thanks to the many responses, we were able to provide suggestions for alternatives, show that there was likely a significant volume of paperwork affected, and that tracking down these customers to obtain new POAs would be extremely burdensome to dealerships—and to counties that would need to reject and re-process this paperwork.  The state Titles and Registration department did decide to make allowance for these incorrectly dated forms—a strike-out of the date and a statement-of-fact will be allowed for these.  All dealerships need to ensure that the bottom signature of the person exercising the power of attorney is not completed or dated until the title is in-hand.  For example, if there is a lien pay-off the date of execution cannot be the trade-in date—alerting county and state personnel that the form has been improperly dated.

FRED F. EMICH JR. PASSES AWAY

With his bride of 61 years by his side, Fred F. Emich, Jr. died peacefully on Friday, February 10, 2012 at the age of 85. He is survived by his devoted wife, Barbara Ann (nee Ganey) Emich, five beloved children, Fred F. III (Carol) of Littleton, CO and Scottsdale, AZ, Daniel T. (Mary Jane) of Arvada, CO, Ann Emich Black of Dillon, CO, Mary E. and Thomas G. (Jeri) of Tucson, AZ; and 11 grandchildren.

TOMMY FERGUSON OF FERGUSON BUICK GMC IN COLORADO SPRINGS PASSES AWAY

May 15, 1939 - February 6, 2012 NORMAN Tommy Wade Ferguson, age 72, of Norman, OK, passed away February 6, 2012. He was born May 15, 1939, in Rush Springs, OK, to Emory Thomas & Luna Mae Ferguson. Tommy is survived by his wife of 19 years, Irene, of the home; 2 sons, Jerry Ferguson & wife Melanie of Owasso, OK & Joe Ferguson & wife Pam, of Norman; step-children, Kelly Rice & wife Liz of China & Kim McKee & husband Jeff of Norman; 11 grandchildren, Ryan Ferguson & wife Leslie of Bixby, Rachel Ferguson of Tulsa, Taylor Ferguson of Owasso & Parker Ferguson of Norman, Chelsea Reimche & husband Conrad, Norman, Hunter, Holden & Hayden McKee of Norman, Max, Beck & Jaxx Rice of China; 4 great-grandchildren, Maguire & Macallen Ferguson of Bixby, OK, Braxton & Jett Reimche of Norman; 1 brother, Wayne Ferguson & wife Cindy of Norman; 1 sister, June Ledbetter of Ozark, MO; & a host of other loving family members & friends.
