AUTO DEALER LAW: NEW LEGAL & FEDERAL COMPLIANCE GUIDE AVAILABLE TO CADA MEMBERS AT DISCOUNT PRICE!
Two of the most well-respected and nationally renowned dealership attorneys teamed-up to pull together—in one guide—key legal and federal compliance issues that all dealerships need to know. CADA has purchased a quantity of this guide so that we may make it available to our members at a discount. The standard price is $395—CADA members are able to purchase through CADA at $295. Further, members who have also purchased a Colorado Dealer Compliance Guide covering state issues will receive another $25 discount.
Auto Dealer Law is divided into three parts:
Part I: Buying and Selling the Dealership discusses the many aspects of dealership buy/sells including what both the buyer and the seller should be looking for, standard and essential contract terms, and factory approval issues. In addition, this part addresses issues related to bankruptcy and the closing of dealerships.
Part II: Running the Dealership focuses on the myriad of legal issues involved with running dealerships. These issues include public, employee, vendor, factory, and finance company relationships. This part also discusses litigation management, insurance, parts and service, antitrust concerns, record retention, and emergency preparedness.
Part III: Compliance devoted entirely to legal compliance. Dealers continue to struggle with an ever-expanding array of laws and regulations relating to sales, finance, advertising, and vehicle titling. These compliance issues are as numerous as they are complex. This part sets forth federal compliance requirements in easy to understand terms. This part also provides some best-practices in the sales and finance arenas while mentioning some state law compliance issues to look out for.
The authors – more about both authors available at: http://www.autodealerlaw.com/authors/
Mike Charapp (right), a partner in the law firm of Charapp & Weiss, LLP, has spent his life in and around the automobile business. Mr. Charapp advises and represents hundreds of dealers and is highly regarded as one of the top dealer attorneys in the country.
Rob Cohen (left) is an attorney and president of Auto Advisory Services, Inc. Rob developed a strong background inside dealerships by working as a car salesman and doing F&I during law school. Rob is a nationally recognized and leading expert in the field of auto dealer legal compliance. Auto Advisory Services has a client base of nearly 500 dealerships.

REMINDER! MAKE SURE ALL SALESPERSON LICENSES ARE CURRENT
More instances of unlicensed salespersons continue to come before the dealer board, and the Auto Industry Division has indicated that more cases are coming. It is coming to light that many dealerships have overlooked renewals or have not followed through to ensure that all applications submitted were issued. Dealerships must ensure that every salesperson has been issued a license and that the license is on display. A salesperson cannot sell until a license is issued by the Division. These cases have cost some dealerships up to $7,500 in immediate fines. Colorado Revised Statutes (C.R.S.) 12-6-109 provides the following:
Display, form, custody, and use of licenses. . . . The license of each motor vehicle salesperson shall be mailed to the business address where the salesperson is licensed under this article and shall be kept by the salesperson at such salesperson's place of employment for inspection by employers, consumers, the executive director, or the board. It is the duty of each motor vehicle dealer . . . to display conspicuously such person's own license in such person' place of business.
Regulation 12-6-109. Each salesperson's license shall be posted in a conspicuous place in the dealer's place or places of business. (1 C.C.R. 205-1)
KPA’s HotlinkHR™ provides a license and certificate-tracking feature for just this purpose:
- Define and setup which licenses to track and which job positions have a license requirement. The system automatically reminds the HR administrator to obtain the license when a person is hired for that position-type.
- HR administrator adds the license to the employee record when received, along with the license expiration date.
- HR administrator receives reminders when the license is set to expire and can email or print letters to employees requesting new license information.
- HR administrator can run reports that show all licenses set to expire in 30, 60, or 90 days
- When new license information is received, the HR administrator updates employee records with the new expiration date.
In addition to tracking sales licenses many dealerships find this a very handy feature to use for tracking required OEM certifications for Service Techs. CLICK HERE for more on CADA’s recent endorsement and direct contacts to learn more.

The Detroit News, February 20

While many families will put nearly as much money into owning and operating their vehicles in a given year than they will sink into their retirement accounts – and will certainly be more passionate about what they drive than where they keep their cash – few motorists will pay the same attention to getting the most out of their automotive investments than they will their portfolios.
