GREEN CAR PARADE

Denver Auto Show week will start this year on Sunday, March 18, at the Colorado State Capitol with the 5th Annual Green Car Parade.  This is a dealer-supported event that is a mostly “static” parade featuring new fuel-efficient cars currently available in your showrooms. 

Each year’s Green Car Parade has been a huge success.  Each parade has displayed more than 40 “green” vehicles from dealerships in the metro Denver area. The parade has received more than 19 broadcast media hits and an overwhelming response from the public.

Here is how it works.  You are invited to have drivers bring a variety of “green” vehicles to the Colorado State Capitol lining up beginning at 1:00pm on Sunday, March 18.  The cars will be displayed with others in the Colorado Capitol circle drive.  Signage will be placed in each vehicle with the name of your dealership, the make and model of the vehicle and how it is environmentally friendly (hybrid, plug-in hybrid, electric, clean diesel, flex-fuel, super high-efficiency).

Just after 3:00pm all participating vehicles will travel in a parade from the State Capitol along the streets of downtown Denver to the Colorado Convention Center.  After the parade, the vehicles will continue back to the dealership.  There will be a few comments by policymakers who support “clean, green” cars.  In case of inclement weather, the event will be cancelled.

Q&A: CAN A DEALERSHIP RE-SELL A TRADE-IN BEFORE HAVING OBTAINED THE TITLE?

This is a frequent question by dealerships.  There is not a specific mandate in Colorado to have already obtained title to a trade-in prior to sale.  However, other requirements do apply after subsequent sale to deliver title to the customer in a timely manner and perfect the lien.  At a minimum, the trade-in should be reviewed for any potential problems before a trade is sold to ensure these obligations can be met.  The key excerpts from the CADA Dealer Compliance Guide are below:

Dealers must deliver, or facilitate the delivery, of the certificate of title to the customer or the lienholder within thirty (30) days of purchase. [C.R.S. 42-6-112]   In effect this means that in the case of a cash sale, the dealer must deliver the title to the customer within thirty days of the sale.  In the case of a financed sale, the dealer must make the registration application and application for a certificate of title to the proper department of motor vehicles within thirty days.

Lender Responsibility to Timely Provide Lien Release/Title:  The key challenge most dealers face in delivering title to customers in a timely manner relates to obtaining title from a lender when there is an outstanding lien or payoff required.  In 2011, legislation was passed requiring lenders to provide the necessary lien release within 15 calendar days of pay-off, unless there are “extenuating circumstances” (which do not include ‘negligent’ acts by the lender, for example the title was just ‘lost’).  [C.R.S. 42-6-125]   At present, the primary enforcement would be in court, but the lender associations have agreed to help address problems in this area.  If a lender is not meeting the 15-day requirement under this statute, report the issue to CADA:  info@coloradodealers.org

Lien Perfection Requirement:  30-Days
If the dealer fails to file the application within thirty days and the customer files for bankruptcy, the lender may lose its lien in the bankruptcy and require the dealer to repurchase the financing.  In that event, the dealer may be left with only an unsecured claim against the customer in bankruptcy.  Note that the lien is perfected on the “date received” at the county (subject to the most critical information and fees being provided).

LEN LYALL OF LEN LYALL CHEVROLET, INC. PASSES AWAY

Lyall, Len, 81, peacefully passed away on March 2, 2012. He is preceded in death by his loving wife, Marge, of 58 years. Len is survived by his sister, Iris Whitehouse, his three children: Jim, Jennifer, and Jayne Lyall, and his eight grandchildren. Len was a respected auto dealer in Aurora for 36 years. He was born in Detroit, Michigan and began his auto career there, working in a dealership, and starting an auto parts business. His life long dream of becoming an auto dealer was realized in 1976 when he moved to Colorado and established Len Lyall Chevrolet, Inc. For many years his beloved wife worked alongside him as did one of his daughters and his son, it was truly a family enterprise.
