DEALERS URGED TO PARTICIPATE IN NADA WORKFORCE / COMPENSATION STUDY
Deadline Approaching Next Week—May 2nd

NADA and ATD member dealers have until May 2, 2012, to take part in NADA’s new Dealership Workforce Study (DWS) that will analyze employee compensation, benefits, turnover and other data. There is no cost to participate in the study. This enhanced annual study replaces the prior biennial NADA Compensation Study.

The study will provide dealers with valuable comparative data to assess and adjust, if necessary, their employee compensation programs, health and retirement benefit packages, and find out what it takes to be competitive in recruiting new employees,”
said Marilynn Youngs, senior director of NADA University.

The online survey should take you about 20 minutes to complete! You do not have to go through your payroll records at all. Simply download your payroll data from your DMS, save in the Excel template provided on the DWS website, and upload using the secure web server. Follow the step-by-step instructions on the DWS website.

***Visit the survey web site to participate***
www.nadaworkforcestudy.com
Participating dealers receive an individualized comparison report (Basic Report) and a Driven Management Guide summary report at no charge.

Why should I participate in the DWS?

  • Learn how your dealership compares to other dealerships in terms of compensation, benefits, retention, turnover, and other factors—and fine-tune your pay plans and benefits packages to enhance your recruitment, motivation, and retention efforts
  • Make the results as complete, detailed, and statistically valid as possible—the more participants, the more authoritative the study can be
  • Provide the data to enable NADA and your state and metro associations to better serve your interests in legal and legislative matters
  • Provide information that NADA University can use to determine the HR issues facing dealers and to develop the educational solutions needed to address those issues

Additional Information:

CADA Open Road is now beginning its sixth year of service, providing uninterrupted weekly news and information for Colorado automotive professionals to better compete in our industry, since January 3, 2007.

NLRB POSTER IMPLEMENTATION HALTED
NADA-supported legal challenge upheld by D.C. Court of Appeals

NADA, through its membership in the Coalition for a Democratic Workplace (CDW), has succeeded in its recent challenge to a National Labor Relations Board (NLRB) requirement that dealers and others prominently display a new “employee rights” poster. Earlier today, a three-judge panel of the D.C. Court of Appeals granted CDW’s request for an injunction, delaying the new poster requirement until the Court has a chance to hear arguments and rule on CDW’s appeal of a lower D.C. court’s ruling that upheld the NLRB’s poster requirement. For more information on the poster, please click here. You can view the injunction here.

This injunction comes on the heels of a federal district court in South Carolina decision striking down the NLRB's notice posting rule in response to a challenge by the U.S. Chamber of Commerce.

The NLRB has posted the following on its web site:

Important note: The DC Circuit Court of Appeals has temporarily enjoined the NLRB’s rule requiring the posting of employee rights under the National Labor Relations Act. The rule, which had been scheduled to take effect on April 30, 2012, will not take effect until the legal issues are resolved. There is no new deadline for the posting requirement at this time.

Accordingly, dealers should not post the new notice at this time.  More information will be provided as it becomes available.

ALTERNATIVE FUEL TAX CREDIT BILL SIGNED BY GOVERNOR—TO ENSURE CONSUMERS OBTAIN TAX CREDIT INCENTIVES ON LEASES

On April 12, 2012, HB12-1299 was signed into law by the governor.  Starting with the 2012 tax year, this bill will remove confusion on alternative fuel tax credits on leases.  Some consumers in Colorado had received notices they were ineligible for previously claimed tax credits after audits revealed that both the leasing company and the consumer had taken the credit. Department of Revenue regulations had given priority to the leasing company, and no documentation was required upfront to prove eligibility.
