CONSUMER TAX INCENTIVES FOR ALTERNATIVE FUEL VEHICLES
Now called “Innovative Motor Vehicle” Tax Credit

At least one manufacturer is running advertisements in Colorado promoting income tax incentives available to consumers who purchase various alternative fuel vehicles.  Dealerships are advised to train salespersons to be very careful to not provide tax advice or assurances to consumers regarding what incentives they can claim.  Individual tax situations vary.  Recently in Colorado over a hundred consumers received notices from the Department of Revenue that they had to pay back income tax credits when it was discovered the leasing company had also claimed a credit on the same vehicle.  There was no upfront verification required to claim the credit, and many were confused.  Some dealers were caught in the middle of this confusion.   While that situation was fixed legislatively this past year, it illustrates the confusion that can surround any tax incentive.  Visit the prior articles, “State Alternative Fuel Tax Credits: Beware of Confusion on Leases”, CADA Open Road, 3/27/2012 and “Alternative Fuel Tax Credit Bill Signed By Governor—To Ensure Consumers Obtain Tax Credit Incentives on Leases, 4/24/2012.  

The recommended way to assist consumers is to refer them to the best available information of which we are aware on the Department of Revenue’s Individual Income Tax information page.   

However, while alternative fuel tax credit information is included upfront on that page, that publication has now been <replaced> by a newer document for “Innovative Motor Vehicle credit” that applies to purchases after January 1, 2012.  The most current information for 2012 purchase-years and after is in FYI Income #67.

The gist of this tax credit for purchasers is as follows:

  • It is an income tax credit, claimed on an individual or businesses’ annual income tax return.
  • The amount of the credit is a designated percentage (see the table) of the difference in value between the most ‘similar’ model that does not use alternative fuels. 
  • Each year staff at the Dept. of Revenue goes through all eligible models to define that ‘similar model’ value difference, applies offsets for any federal tax credits, and publishes the precise dollar amount of the credit.  Purchasers can be referred to this DOR publication as the best source of information available. 
  • Specific tax credit dollar amounts will not likely be published for 2013 models until Dec/January.  However, looking over prior years listed on the FYI Income #9 provides a good basis that the amounts have not typically changed all that significantly from year to year (though there is no guarantee that will remain the case in future years).
  • For more specific information, purchasers need to consult a tax professional, or check with Dept. of Revenue directly.

CADA will be offering title processing training!  This session will be conducted by a title training specialist who has worked for both a county, and for a new vehicle dealership.  It will cover intermediate to advanced topics.  More information will be coming. As we are still defining the content of this session, please submit your recommendations for topics, issues, and any recurring problems you would like to see addressed.  It is anticipated that this session will also include a representative from Denver DMV, a former state titles and registration employee, and other county title processing former personnel.
