UPDATED LIST OF BONDED REPOSSESSORS FROM COLORADO ATTORNEY GENERAL

Several Colorado statutes relate to repossession as a debt collection remedy. Generally, repossession is allowed, with specific requirements that apply to motor vehicles, and additional restrictions that apply to consumer transactions.  This is an area that can be fraught with risk, and numerous requirements under state law must be followed.  The following excerpt is from the CO State Dealer Compliance Guide and relates to the use of a bonded agent:

While dealership employees may be allowed to repossess directly, if the dealership contracts for repossession it must use a bonded repossession service.  Attempting to reclaim property could result in volatile and sometimes dangerous situations, and utilizing a third party experienced in these situations could avoid adverse consequences.  Colorado’s Uniform Commercial Code states that a dealer “shall…only” contract with a bonded repossession service for any repossessions. Colorado law goes on to provide that use of an unbonded repossession service creates an “agency” relationship between the repossessor and the dealer.  [C.R.S. § 4-9-629]  This agency relationship means the dealership is responsible for any actions of the repossession service agent and could create significant liability for a dealer.

CADA will be offering title processing training!  This session will be conducted by a title training specialist who has worked for both a county, and for a new vehicle dealership.  It will cover intermediate to advanced topics.  More information will be coming. As we are still defining the content of this session, please submit your recommendations for topics, issues, and any recurring problems you would like to see addressed.  It is anticipated that this session will also include a representative from Denver DMV, a former state titles and registration employee, and other county title processing former personnel.
