Dealer Alert: NHTSA Consumer Advisory Regarding Counterfeit
Airbags – Dealers Should Be Ready to Respond to Inquiries

Earlier this week, the National Highway Traffic Safety Administration (NHTSA) issued a consumer advisory regarding counterfeit air bags.   While counterfeit parts are an ongoing problem, this alert appears to partially stem from a recent confiscation by federal agents of counterfeit air bags from an auto parts store in the U.S. with an international arm. The counterfeit air bags were allegedly manufactured by purchasing genuine parts to produce molds.  The counterfeits were also fraudulently labeled with manufacturer trademarks so auto body shops may have been unsuspecting purchasers.  The NHTSA alert and most news articles point out that only vehicles that had an air bag replaced in the past three years at a repair shop that is not part of a new vehicle dealership are at risk.  The issue has received a fair amount of press, so dealers should be prepared to respond to consumer inquiries.  NHTSA also included a specific list of vehicles that could be affected.  Below is the NADA alert for dealers on this topic – including a helpful Q&A document for dealers:

Today the National Highway Traffic Safety Administration (NHTSA) announced a consumer advisory on counterfeit air bags. Federal investigators have determined that thousands of counterfeit bags have been bought and installed in U.S. motor vehicles over the past three years. NHTSA also has determined that, in the event of a frontal collision, these counterfeit bags are unlikely to deploy properly or may deploy in a manner that can harm vehicle occupants. All told, vehicles with counterfeit air bags installed are believed to constitute less than .1% of the total in-use fleet. Nonetheless, dealers should be prepared to respond to inquiries from the public on this matter. NHTSA is urging concerned owners to start by visiting http://www.safercar.gov/Air+Bags to determine if they are at risk. In addition to the NADA guidance noted above, dealers should expect to receive communications directly from the OEMs they represent, addressing how to detect and manage counterfeit air bags. Note: unlike for a safety recall campaign, customers should expect to pay to have their air bags diagnosed and, if necessary, replaced.

Additionally, below are some key Colorado provisions regarding airbag replacement – as a reminder:

The Colorado Consumer Protection Act ("CCPA") is designed to protect consumers from deceptive trade practices. The CCPA identifies a number of specific acts that are defined as deceptive.  One of those specific to motor vehicles is summarized below:

Installation or reinstallation of an airbag (“vehicle restraint system”) that is not designed in accordance with federal safety regulations for the make, model and year of the vehicle. Violation is a misdemeanor, with a fine not less than $2,000, and/or jail time.  [Section: Consumer Protection Act, pg. 2 of the Colorado Dealer Compliance Guide].

The Colorado Motor Vehicle Repair Act generally requires that consumers receive an estimate of repair work and consent to the work before it is started, subject to some exceptions. Regarding airbags, it requires the following:

All airbag repairs must be done using factory or salvage parts. If salvage airbag parts are used, the repair facility must obtain written authorization from the customer, and conspicuous disclosure must be prominent on the invoice. The repair facility may not use the terms "used" or "AS IS" to refer to salvage airbag parts. If salvage airbag parts are used, the date of sale of the salvage unit, the VIN or vehicle number from which salvage and the part number all must be included on the invoice.
