REMINDER OF GAP REQUIREMENTS: SEPARATE CONSUMER DISCLOSURE REQUIRED
Colorado Attorney General’s office continues to audit dealers for compliance

The Attorney General’s office continues to actively audit dealers for compliance with the Colorado Uniform Consumer Credit Code (“UCCC”).

A key focus is that the required ‘separate written cancellation form’ is being provided to consumers – with a copy retained in deal jacket files for proof that it was provided.  This separate written cancellation form must be provided on all GAP purchases.  While some lenders may more actively monitor dealer compliance and also require proof, not all do this.  Further, note that it must be a ‘separate’ form.  Dealers should not assume that every GAP company is providing sufficient training and oversight of this notice form that is required in Colorado.

Rule 8 of the UCCC covers GAP and provides the following:

(c) At the time the consumer provides affirmative written authorization to purchase GAP, the creditor shall provide the consumer with a separate written cancellation form. The form shall:

  1. include the name and mailing address to be used to cancel GAP;
  2. state clearly and conspicuously that the consumer has an unconditional right to cancel GAP for a full refund within thirty (30) days after it was purchased; and,
  3. state that in order to cancel GAP, the consumer must complete and return the form or send any other written notice of cancellation to the address provided postmarked no later than thirty (30) days after GAP was purchased

The maximum fines and penalties can be significant—including the refund of all GAP premiums.
