DEALERSHIP INSURANCE BOOKLET MANDATE ELIMINATED
NADA Headlines, Special Edition, Jan. 10, 2013

New-car dealerships are no longer required to provide printed copies of the Relative Collision Insurance Cost Information brochure to car and truck buyers upon request. President Obama signed legislation today that repeals the outdated mandate and eliminates the $1,000 fine that dealerships face for failing to comply with the 1970s-era law.

“This bill removes a regulatory burden from dealerships that helps reduce our cost of doing business,” said Bill Underriner, chairman of the National Automobile Dealers Association (NADA) and a multi-franchise dealer from Billings, Mont.

The booklet was originally designed to provide car buyers with information on the different insurance costs to repair vehicles, but was not helpful to consumers in the showroom. The Obama administration, in a 2011 submission to Congress, said that “a prospective buyer does not need a brochure from the federal government to obtain this information, since insurance agents are trained to provide advice on how model selection affects insurance premiums.”

“For all of the years I’ve been in business, I cannot recall that a customer has ever asked to see the booklet,” Underriner added. “Printing and mailing this booklet has simply been made obsolete by technology.”

In an NADA survey of its members, 96 percent of new-car dealers reported that none of their customers had ever asked to see the brochure in the 21 years dealers were required to stock it. 

The federal government and the Insurance Institute for Highway Safety, which compiles the data, can still make the information available to the public online or by other means. 

Underriner commended the leadership of House sponsors Reps. Gregg Harper, R-Miss., and Bill Owens, D-N.Y., as well as Sens. Amy Klobuchar, D-Minn., and Roger Wicker, R-Miss., who directed the bill through the Senate.



REMINDER: 8300 CASH REPORTING - CONSUMER NOTICES DUE BY JAN. 31ST

Generally, any business that receives more than $10,000 in cash in a single transaction or related transactions must complete a Form 8300, Report of Cash Payments Over $10,000 Received in a Trade or Business.

In addition, businesses must notify those customers that it has filed a Form 8300 regarding their cash transaction(s) -- in writing, by January 31 of the subsequent calendar year.

Presentation Summary:
The purpose of this presentation is to provide a road map for Health Care Reform. Attendees will gain a high level familiarity with key provisions that affect plan sponsors. This presentation will review the phased implementation of Health Care Reform and review key issues that employers need to consider when developing their action plan while considering long-term options for their benefit program.

  • Understand plan sponsorship issues employers face in 2014.
  • Formulate a plan for next steps and long-term options for benefit program.
  • Ensure employer-based health plans are compliant with federal law.

About the presenter:
Susan is a nationally recognized expert and speaker on Health Care Reform. Prior to joining American Fidelity in 2010, Susan was of counsel with the law firm of Miller & Chevalier, Chartered, in Washington, DC, where she advised companies on health policy and compliance issues. Susan specialized in the design, implementation, and administration of health and welfare benefit plans, and was active in the recent Congressional Health Care Reform debate. She's also done extensive writing and public speaking on the various laws impacting group health plans.

Before joining Miller & Chevalier, Susan was with Ernst & Young's Human Capital practice and served as the Health Policy Legal Counsel for the American Benefits Council. She is a graduate of the University of North Texas and Tulane Law School, and is a member of the Texas and District of Columbia bars.
