DEPARTMENT OF LABOR AUDIT ALERT:  DEALER RECEIVES RANDOM AUDIT NOTICE COVERING STATE EMPLOYMENT VERIFICATION LAW

CADA received notice from a Colorado dealer member of a state audit covering the state employment verification requirements.  CLICK HERE for that notice letter and what the department is requesting. Note the following:

  • The dealer had less than two weeks to respond.
  • The audit covers all current employees who were hired as of 1/1/2007 when this law went into effect.
  • The Department advises employers not to complete the affirmation form if it is not done within the required 20 days of hire.

Below is an alert run previously in Open Road, October 15, 2012:

The Colorado Department of Labor and Employment (CDLE) has announced new employment eligibility verification requirements for Colorado employers. The new requirements take effect October 1.

Since January 1, 2007, Colorado employers have had to complete a written affirmation of legal work status for each new hire. They also have been required to retain photocopies of the documentation that employees provide when completing the I-9. 

Beginning October 1, 2012, employers must use a required form. Previously, employers could use any version of the form that met the statutory requirements. The new regulations also clarify thatemployers may not complete the affirmation form after 20 days from the date of hire. 

The CDLE has confirmed that it is conducting compliance audits on 40 Colorado employers each week. "We are regularly contacted by members who have received these audit notices," says MSEC Immigration Services attorney Chris Bauer. "This is a good time to make confirm that your company's records are in good order."

KPA: 2013 HR REGULATIONS UPDATES

With many changes in employment law for 2013 employers should review current Human Resource practices to make sure they are in compliance with new federal and state regulations and rule changes. The Department of Labor and associated agencies have been very active in enforcement and expansion of regulations and all signs point to an even higher level of activity in 2013 so employers must be in compliance to avoid fines and lawsuits.

Presentation Summary:
The purpose of this presentation is to provide a road map for Health Care Reform. Attendees will gain a high level familiarity with key provisions that affect plan sponsors. This presentation will review the phased implementation of Health Care Reform and review key issues that employers need to consider when developing their action plan while considering long-term options for their benefit program.

  • Understand plan sponsorship issues employers face in 2014.
  • Formulate a plan for next steps and long-term options for benefit program.
  • Ensure employer-based health plans are compliant with federal law.

About the presenter:
Susan is a nationally recognized expert and speaker on Health Care Reform. Prior to joining American Fidelity in 2010, Susan was of counsel with the law firm of Miller & Chevalier, Chartered, in Washington, DC, where she advised companies on health policy and compliance issues. Susan specialized in the design, implementation, and administration of health and welfare benefit plans, and was active in the recent Congressional Health Care Reform debate. She's also done extensive writing and public speaking on the various laws impacting group health plans.

Before joining Miller & Chevalier, Susan was with Ernst & Young's Human Capital practice and served as the Health Policy Legal Counsel for the American Benefits Council. She is a graduate of the University of North Texas and Tulane Law School, and is a member of the Texas and District of Columbia bars.
