DEALERS MUST DISPLAY NEW FMLA POSTER BY MARCH 8
NADA 60-Second Email, Feb. 28, 2013

By March 8, 2013, all dealers covered under the Family Medical Leave Act (FMLA) — those with 50 or more employees — must display a new version of the FMLA poster, which can be downloaded here. The newest version of this poster incorporates changes addressing military family and caregiver leave. These include:

  • Defining “covered veterans” as those discharged or released under conditions, other than dishonorable, five years prior to the date the employee’s military caregiver leave begins.
  • Defining a serious injury or illness to be only one of four alternative options.
  • Permitting eligible employees to obtain certification of a servicemember or veteran’s serious injury or illness from any “health care provider,” not just those affiliated with a DOD, VA, or TRICARE network.
  • Extending qualifying exigency leave to eligible employee family members of members of the Regular Armed Forces, and adding a requirement for all military members to be deployed to a foreign country in order to be on “covered active duty.”
  • Increasing the time an employee may take for qualifying exigency leave related to a military member’s R&R leave from five to up to 15 days.
  • Creating an additional qualifying exigency leave to allow for the care of a covered active duty military member’s parent who is incapable of self-care.

REMINDER TO OBTAIN OFF PREMISE PERMITS FOR DENVER AUTO SHOW

This is to remind all member dealers sending sales persons to the Denver Auto Show—which runs March 20th through March 24th this year—that an off-premise permit must be obtained BEFORE the start of the show.  Generally, an off-site permit is required whenever a sales person will be engaging with prospective customers at an event or location away from the primary business location. 

Dealers need to submit the DR2043 application form (4 copies;), along with the required $500.00 fee, by end of business, Tuesday, March 19th, to the Department of Revenue – Auto Industry Division (“the Division”).

NEW!  Note the off premise regulation requires that the permit “shall be posted for inspection”.  We have received calls in prior years regarding the challenge in finding a place to post the permit. Further, it would assist regulators to have these centralized as well.  This year, we will make available a centralized bulletin board where these off-premise permits can be posted; information will be provided at the Exhibitor/Dealer check-in booth.

CACI-Opposed Bill Expanding Eligibility for Family Medical Leave Passes First House Hurdle
Yesterday afternoon, the House Health, Insurance and Environment Committee amended and then approved HB-1222, which would expand the eligibility of those with "a serious health condition" for whom an employee could take leave from work to care for under the 1994 Federal Family Medical Leave Act (FMLA).

CACI-Opposed "Wage Theft" Bill Set for First House Committee Hearing
HB-1227, sponsored by Representative Jonathan Singer (D-Longmont), is scheduled to be heard by the House Business, Labor, Economic and Workforce Development Committee when it convenes at 1:30 p.m. on Thursday, march 7th, in Room A of the Legislative Services Building. 

The bill seeks to create criminal penalties for employers who are found guilty of so-called “wage theft.”

The bill also contains a so-called “private right of action,” a provision beloved by trial lawyers that would allow an aggrieved ex-worker to file a civil suit against the employer under certain conditions.

Amended Credit-Check Bill Awaits First House Committee Hearing
The House Business, Labor, Economic and Workforce Development Committee has scheduled SB-18, the amended credit-check bill, for a hearing on Thursday, March 7th, when the Committee convenes at 1:30 p.m. in Room A of the Legislative Services Building.

MILTON VANDIVER, FORMER DENVER DATSUN DEALER, PASSES AWAY

Milton Vandiver of Littleton, was born in Charlotte, NC. He was preceded in death by his loving wife, Leona. He was a wonderful husband, father, grandfather and great grandfather. He is survived by his two daughters Connie Sparks (Jim) and Charlotte Strauss (Cary); grandchildren Mat, Sandra, Kristan, Jason and Zach; grandson-in-laws Danny and Colin; and great grandchildren Diandra, Danton, Haley and Kendall. Milton, known to all as Van, proudly served our country as a Marine In World War II's Pacific Campaign. After the war, Van and Leona settled in Denver where he had a successful career in the automobile industry. Van passed away on Feb. 26 in the loving care of his family and compassionate staff at Heritage Club Lakewood. Services will be held at Ft. Logan Nat'l Cemetery on Tues., March 5 at 2PM, "Staging A".
