NADA'S 2013 DEALERSHIP WORKFORCE STUDY HAS LAUNCED AT

REMINDER: COLORADO LAW LIMITS MANUFACTURER WARRANTY / INCENTIVE CHARGE-BACKS TO NINE MONTHS

A frequently asked question we receive:  “What is the charge-back period for manufacturer audits under Colorado dealer franchise laws?” 

As a reminder, in 2009 a time limitation on charge-backs of any warranty, sales, or incentive claims was added into Colorado law; in 2010 this was amended to a shorter period of nine months.   Note that the nine month limitation also applies to dealer submission of claims as well, to preclude unreasonably short timeframes.

There is an exception that manufacturers can require documentation going back fifteen months—the result of legislative compromise with manufacturers that argued for a longer time period if fraud was suspected.  However, the time period of nine months applies to any charge-backs unless the manufacturer files an action for fraud with a court of law.

NADA AND NAMAD QUESTION CFPB'S APPROACH IN ITS GUIDANCE ON AUTO LENDING

Recently, the Consumer Financial Protection Bureau (CFPB) issued to those finance sources that are subject to its authority some unfortunate guidance concerning indirect auto lending. A copy of that guidance is available here and the press release announcing it here.

In response, NADA, together with NAMAD, issued a statement available here. Both the Regulatory Affairs and Legislative Affairs Committees will be discussing this issue in depth at their meetings early next month and will be refining NADA’s continued advocacy on this important issue.

The Consumer Financial Protection Bureau (CFPB) issued a bulletin on March 21, 2013 directed to at least four finance companies that participate in indirect vehicle financing. This bulletin notifies lenders that the CFPB is contemplating enforcement actions against the finance companies over dealer-assisted financing. The CFPB apparently believes that the dealer-assisted financing practices create a “significant risk of pricing disparities on the basis of race, national origin” or other protected groups. The CFPB’s methodology supporting these findings is suspect and subject to legal challenge.

The Denver Press Club presents its premier event of the year, the 19th Annual Damon Runyon Award Banquet. Our honoree and guest speaker is Mike Lupica, sportswriter and cityside columnist for the New York Daily News, broadcaster, radio host and book author.

Tickets are $90 for members of the Denver Press Club, Denver Woman's Press Club, Colorado Press Women, the Colorado chapter of the Society of Professional Journalists, the Colorado chapter of the Public Relations Society of America and the Colorado Association of Black Journalists. For the general public, tickets are $110 each.
This event is open to everyone. In addition, DPC offers a $25 ticket to attend the VIP reception at the club, which goes from 5-6 p.m.

MOUNTAIN STATES TOYOTA WINS PRESIDENT'S CABINET AWARD

Mountain States Toyota has won Toyota’s most prestigious and coveted award…. President’s Cabinet. The President’s Cabinet is awarded to only 12 Toyota dealers in the USA. There are over 1200 Toyota dealers nationally thus making Mountain States Toyota in the top one percentile.

To achieve this award the dealership must attain The Board of Governors Award which is comprised of the top 60 Toyota dealers in the nation. Secondly the dealership must attain the President’s Award which recognizes superiority in Service, Parts and Customer Service. Once these awards have been achieved Toyota then reviews guest experience data to determine the President’s Cabinet winners.

The best part of the 2012 President’s Cabinet is that Mountain States Toyota has won this award back to back in the years  2011 and 2012 respectively. They are the only Toyota store in Colorado to win the Toyota President’s Cabinet in 2011 and 2012!

Mountain States Toyota also has won the distinguished Circle of Excellence Award which is presented by Toyota Financial Services. They are one of 26 Toyota stores nationally to win this award.

Finally, Mountain States Toyota has been recognized as one of “ Top 100 Denver Work Places 2013” sponsored by the Denver Post. This will be announced publicly the week of April 15th, 2013.
