OSHA TARGETING DEALERSHIPS WITH LOCAL EMPHASIS PROGRAM - INCLUDES COLORADO

OSHA is targeting automotive repair and maintenance businesses, including new-car dealerships, through a Region 8 [which includes Colorado] Local Emphasis Program. This focused inspection activity, scheduled for between April 16 and at least Sept. 30, 2013, stems from five complaints OSHA Region 8 received in FY 2010, all of which resulted in citations. NADA urges dealerships nationwide to review the inspection directive and their health and safety compliance. Dealerships with specific questions regarding their compliance should contact NADA Regulatory Affairs at regulatoryaffairs@nada.org or their state or local dealer association.

CONSUMER TAX INCENTIVES FOR ALTERNATIVE FUEL / INNOVATIVE VEHICLES: NEW STATE LAW

One of the key bills CADA supported during the recent legislative session was HB13-1247 to restore consumer income tax incentives for the purchase of various “innovative vehicles.”  The bill was signed on May 15, 2013, and is effective for the current tax year.

At the end of December, 2012, the Colorado Department of Revenue (Department) announced that numerous vehicles and credit amounts previously included on the primary tax publication for alternative fuel / innovative vehicles were in error.  Several popular vehicles were included when they should not have had any eligible credit and some others had incorrect amounts.

To address various popular models for which tax credits no longer existed, and to simplify the calculation of these credits, numerous groups sought and obtained legislative change.

Currently the best ‘official’ source of guidance for the new law is the legislative Fiscal Note for the bill—this would be the resource to direct consumers.  The Department is working on a revised publication/summary, but it is unclear when it may be completed.

CLICK HERE for the full CADA memo with more details.

IMPORTANT:  Do not give tax advice to consumers.  As a reminder, the recommended way to assist consumers is to refer them to the best available ‘official’ information, and currently that is the Fiscal Note.   All persons considering the use of available incentives should consult with their own tax professional to determine eligibility, specific amount of benefit available, if any, and further details.
