OSHA AUTOMOTIVE LIFT INSPECTIONS MANDATE
Colorado dealerships are being actively targeted for audits

OSHA Region VIII Automotive Lift Inspections Mandate

SUMMARY:

Recently, federal OSHA Region VIII began targeting automotive dealerships and other automotive service and body shop facilities. These inspections are intended to identify possibleunsafe work practices that may be in violation of federal OSHA safety standards. The OSHA Region VIII Local Emphasis Program (LEP) Directive Number 13-12 (CPL 04-05) will expire on September 30, 2013. OSHA Region VIII covers the states of Colorado, Montana, North Dakota, South Dakota, Utah, and Wyoming. Both Utah and Wyoming have state operated OSHA programs.

Compliance

Due to the aggressive enforcement program, ensure that the following regulations are being followed to remain compliant:

  1. Ensure that all lifts have a properly functioning locking mechanism that will prevent the lift from collapse in the event of a pressure failure.
  2. Ensure that all lifts have legibly posted information related to the load capacity, operating instructions, and other pertinent manufacturer information and warnings.
  3. Ensure that all employees who use or may use lifts are provided with necessary lift safety training.
  4. Ensure that lifts are periodically inspected by qualified inspectors annually.

Fines and audits are highly active in Colorado; ensure that you are compliant to avoid citations.

KPA RECOMMENDATIONS:
KPA has recently witnessed an unprecedented level of unannounced OSHA automotive related facility safety inspections. It appears automotive annual lift inspections and current technician automotive lift training are at the fore front of these inspections. Other areas of review include implementing a compliant Hazard Communication Program, Personal Protective Equipment Program, and Emergency
Response Programs. This is not an exhaustive list of compliance issues targeted, but items that may represent the priorities of this LEP.

NO SALES/USE TAX RATE CHANGES EFFECTIVE JULY 1, 2013

The state Department of Revenue – Division of Taxation posts sales and use tax changes prior to January 1st and July 1st each year.  Dealerships should be aware of these dates and be on the lookout to ensure the tax database being utilized reflects these changes. Keep in mind that all state-collected jurisdictions must report and changes are effective on these two dates each year. However, home-rule jurisdictions that are self-collected, can change at any time.  While many still adhere to these timeframes and report to the state, their changes may not always be reported.

The latest state alert confirms there are no rate changes effective July 1st and also contains a link to a new state taxation blog:

There are no new taxes or tax rate changeseffective July 1, 2013.

Contact information for home-rule cities is listed in the publication DR 1002, Colorado Sales/Use Tax Rates, which is updated around January 1 and July 1 each year.

PINNACOL 2013 RISK MANAGEMENT SYMPOSIUMS 

Pinnacol offers free and low-cost training to its policyholders throughout the year. For the fourth year, Pinnacol will be hosting two comprehensive symposiums that offer multiple classes in a consolidated format. These sessions are designed to keep employees safe, return employees to work if they are injured, and provide tips and resources to keep workers’ compensation costs down.

Policyholders are invited to attend these free sessions.  Attendance will count as one class toward your safety group training requirement (two classes per year). 

The symposiums will be held in two convenient locations — Denver and Grand Junction.
