EPA PROVISIONALLY EXCLUDES SOLVENT WIPES FROM HAZARDOUS WASTE RULES
NADA 60-Second Email, 7/24/2013

Yesterday, EPA issued a rule conditionally excluding solvent-contaminated wipes from its hazardous waste regulations, provided dealerships manage them properly.

The wipes used in dealership service and autobody operations run the gamut from woven laundered cloths to paper disposable wipes, wipers, shop towels and/or rags. Some are used with solvents, others to wipe up liquids such as oils, greases, paints and antifreeze.

Generally, wastes contaminated with EPA-listed solvents become “hazardous” and must be managed as such. Under the new rule, used wipes contaminated with EPA-listed solvents are not “hazardous” waste if they are:

1. Stored in closed, labeled containers.
2. Liquid-free when sent off-site for cleaning or disposal.
3. Not accumulated for longer than 180 days.

Service and body department wipes are used with numerous liquids and for various purposes, and are often intermixed prior to off-site cleaning or disposal. Consequently, dealerships should consider implementing the above three management strategies for all used wipes.

The push to obtain regulatory relief for rags and wipes began in 1992. Through the years, NADA filed several sets of comments, formally participated on a Small Business Regulatory Enforcement Fairness Act panel, and met numerous times with EPA. The protracted deliberations leading up to yesterday’s final rule largely can be attributed to a competitive battle between disposable wipe manufacturers, their reusable wipe counterparts, and commercial laundries.

Caution: state law variations may exist with these and other hazardous waste rules. For more information on EPA’s new rule click here or contact NADA Regulatory Affairs at regulatoryaffairs@nada.org or 703.821.7040.

UNDERSTANDING THE IMPACTS OF THE AFFORDABLE CARE ACT / HEALTH CARE REFORM

Anita Baker
Is the managing partner of the employee benefit plans practice at CliftonLarsonAllen (CLA) where she specializes in providing assurance, tax and consulting services to plan sponsors and third party administrators.

Mrudul Sharma
Is a manager in the dealership group for CliftonLarsonAllen.  He is responsible for planning and managing financial statement and tax engagements for dealership clients.

Presentation Summary

Beginning in 2014, many individuals will be required to have minimum essential health insurance coverage or pay a penalty (an individual mandate). Certain employers with more than 50 full‐time employees who do not offer qualified health insurance or offer unaffordable coverage may be subject to penalties if any of their full‐time workers enroll in exchanges and receive premium assistance tax credits.

Mrudul Sharma and Anita Baker will provide an overview of the Affordable Care Act (ACA), including the regulatory requirements for 2013 and beyond. They will also discuss a case study of a dealership that illustrates the financial impact that the ACA has on the dealership and the factors that influence.

By the end of the presentation, participants will be able to:

  • Identify new administrative requirements and a timeline each takes effect
  • Understand plan sponsorship issues employers face in 2014.
  • Formulate a plan for next steps and long-term options for benefit program.
  • Ensure employer-based health plans are compliant with federal law.

Colorado Court of Appeals Decision allows termination of employees for marijuana use

PHIL LONG FORD OF CHAPEL HILLS NAMED ONE OF THE TOP 100 BEST DEALERSHIPS TO WORK FOR

Phil Long Ford of Chapel Hills has been named one of the top 100 best dealerships to work for in the country by Automotive News. This is the only dealership in the state of Colorado to be recognized with this honor. http://www.autonews.com/Assets/html/bestdealerships/

Automotive News chooses dealerships for the list based on workplace satisfaction, talent retention and fair treatment of employees. Phil Long Ford of Chapel Hills excels in all categories.

At the dealership, employees can earn up to $50 per month toward their portion of health care premiums by participating in and keeping a log of healthy activities such as exercising, healthy eating, losing weight and quitting smoking. These activities are made easier through the use of an in-house gym, a Weight Watchers program, and one or two health fairs each year. A massage therapist is even brought in quarterly for employees. Another way the dealership keeps employees happy is through a quarterly celebration at which employees gather to eat, talk about the state of affairs at the dealership, ask questions and honor members of the sales and service staff for outstanding performance.

LET US KNOW ABOUT YOUR ACCOMPLISHMENTS!
