HOW TO WIN UNEMPLOYMENT INSURANCE (UI) CLAIMS

Michelle Magruder has extensive trial and hearing experience, particularly in the areas of employment law and personal injury. In addition to representing parties in employment litigation, Michelle also counsels clients in employment law matters. She has represented private companies, insurance carriers and other entities in the defense of employment discrimination claims, unemployment insurance claims, wage and hour claims, contract disputes and general liability claims. She works as a consultant for private companies in the areas of risk management and employment law, and performs management training.

Presentation Summary

HOW TO WIN UNEMPLOYMENT INSURANCE CLAIMS
This presentation will cover the “best employment practices” a dealership needs to follow in order to prevail on an unemployment claim filed by a former employee.  This presentation will discuss what to expect during an unemployment hearing and how to prepare for a hearing.  We will cover the basics of the Colorado statutes which govern unemployment benefits, including all the reasons a former employee can be disqualified from receiving unemployment benefits.  While attending this presentation, you will learn the basics of the Colorado unemployment benefit laws and the required processes of the law.  This presentation will provide useful tools for winning an unemployment claim which will protect the dealership from unjustified claims.

Colorado Court of Appeals Decision allows termination of employees for marijuana use
On April 25, 2013, the Colorado Court of Appeals issued an Order which held that an employee who tests positive for using marijuana (including medical marijuana) can be terminated by his or her employer pursuant to the employer’s written drug and alcohol policy.  We will provide information on what should be included in an employer’s written drug and alcohol policy and under what circumstances an employer can require a drug/alcohol test of an employee.  The importance of proper documentation concerning the termination of an employee who tests positive for drugs/alcohol will also be discussed

DOT RELAXES SOME HAZMAT SHIPPING REQUIREMENTS
NADA 60-Second Email, Aug. 12, 2013

A new U.S. Department of Transportation rule relaxes the hazardous material (hazmat) shipping requirements for air bags and seat belt pretensioners. Dealership parts and service departments and body shops receive and/or ship a variety of hazmat, including chemicals, batteries, solvents, oils, and wastes in addition to air bags and seat belt pretensioners. Effective August 29, 2013, the new federal rule eliminates the need to obtain explosive (EX) numbers for use on shipping papers accompanying air bag modules, inflators and seat-belt pretensioners. It does not, however, modify the mandate that dealerships properly package and mark these items prior to shipment. It also does not modify the need for dealership employees who receive, ship, or transport hazardous materials to be trained every three years on the DOT’s hazmat packaging, labeling, and shipping rules. NADA’s A Dealer Guide to the Federal Hazmat Transportation Regulations (publication L37) is currently being revised to reflect these and other recent changes.

Accidents happen … that’s the reason you have workers’ compensation coverage. Having a strong safety program will keep on-the-job injuries to a minimum. But when injuries occur — and they will — it is important to have a return-to-work program in place. A return-to-work program is a proactive process used by an employer to help employees who have suffered work-related injuries or illnesses return to their previous economic, social and vocational status. From the employers’ standpoint, a return-to-work program can:

  • Speed your injured workers’ medical recovery
  • Reduce claims costs
  • Hold down your workers’ compensation premiums

Building Your Return-To-Work Program
Regardless of your organization’s size or industry, there are some basic steps to building your return-to-work program.

Step One — Create a written return-to-work policy
Step Two — Create modified-duty task lists
Step Three — Understanding and implementing the modified-duty work offer process

UNDERSTANDING THE IMPACTS OF THE AFFORDABLE CARE ACT / HEALTH CARE REFORM

Is the managing partner of the employee benefit plans practice at CliftonLarsonAllen (CLA) where she specializes in providing assurance, tax and consulting services to plan sponsors and third party administrators.

Mrudul Sharma
 Is a manager in the dealership group for CliftonLarsonAllen.  He is responsible for planning and managing financial statement and tax engagements for dealership clients.

Presentation Summary

Beginning in 2014, many individuals will be required to have minimum essential health insurance coverage or pay a penalty (an individual mandate). Certain employers with more than 50 full‐time employees who do not offer qualified health insurance or offer unaffordable coverage may be subject to penalties if any of their full‐time workers enroll in exchanges and receive premium assistance tax credits.

Mrudul Sharma and Anita Baker will provide an overview of the Affordable Care Act (ACA), including the regulatory requirements for 2013 and beyond. They will also discuss a case study of a dealership that illustrates the financial impact that the ACA has on the dealership and the factors that influence.

By the end of the presentation, participants will be able to:

  • Identify new administrative requirements and a timeline each takes effect
  • Understand plan sponsorship issues employers face in 2014.
  • Formulate a plan for next steps and long-term options for benefit program.
  • Ensure employer-based health plans are compliant with federal law.

Would you know what to do in the event of a cardiac emergency? Are your employees trained to recognize and care for an injured worker until the paramedics can arrive? CPR (cardiopulmonary resuscitation) and AED (automated external defibrillator) training can help when there may be only minutes to respond.

Between improper installations, unsafe work practices and inadequate training, electricity continues to be a leading cause of both fatal accidents and OSHA citations in the workplace. This course will address specific OSHA and NFPA standards pertaining to safe electrical work practices.
