Employee Handbooks: Revising or Developing

has been a staff member of the Human Resource Services
group at Mountain States Employers Council for the past eight years. Prior to accepting a position with MSEC, she worked in the field of HR in the banking and retail sectors. Bev instructs a variety of HR courses for the Council, including Interviewing, Performance Management,  Violence, Recordkeeping, Employee Handbook, Social Media, Onboarding, Succession Planning and Business Ethics.

Presentation Summary: This seminar will provide participants with an overview of the process necessary to develop or revise an employee handbook. The seminar covers minimizing legal risk and developing a handbook reflective of an organization. After attending this seminar, participants will be able to develop or revise an employee handbook that preserves at-will employment and will be prepared to write or revise a handbook to minimize an organization’s legal risk.

HEALTH CARE REFORM - EMPLOYEE NOTICES DUE BY OCTOBER 1ST

The U.S. Department of Labor (DOL) has provided “temporary guidance” regarding the written notice employers are required to provide to their employees under the Patient Protection and Affordable Care Act (PPACA). PPACA requires that applicable employers must provide each employee with a written notice providing the employee with information about the state and federally-facilitated health insurance exchanges and how to request assistance, describing the availability of a premium tax credit (if applicable) and outlining the implications for the employee if they choose to purchase a qualified health plan through an exchange. The notice requirement was originally scheduled to take effect on March 1, 2013, but subsequent guidance has indicated that the timing for distribution of notices will be the late summer or fall of 2013* in coordination with the open enrollment period for exchanges.

Along with technical release, the following model notices have also been issued by the DOL:

Dealers should consult their health care consultant, insurance carrier or other outside professional to determine which form is appropriate for your dealership, and how to properly complete and distribute that form to your employees. Click here for DOL’s Technical Release No. 2013-02.

*Revised Timing for New Notices:  Employers are required to provide the notice to each new employee at the time of hiring beginning October 1, 2013. With respect to employees who are current employees before October 1, 2013, employers are required to provide the notice not later than October 1, 2013.

NEW FEDERAL CROSS-AGENCY EFFORT ON EMPLOYER I-9/E-VERIFY PRACTICES
By Mountain States Employers Council

​The Office of Special Counsel for Immigration-Related Unfair Employment Practices (OSC) and the National Labor Relations Board (NLRB) have entered into an agreement that the two agencies will “share information, refer matters to each other, and coordinate investigations as appropriate.” The NLRB may begin referring cases to the OSC when it identifies potential employment discrimination practices based on citizenship status or national origin, including discrimination during the employment verification process. Conversely, the OSC may refer cases to the NLRB when it discovers labor relations issues during its investigations.

The OSC’s primary role is to investigate and enforce the anti-discrimination provisions of the Immigration and Nationality Act (INA), such as discrimination in hiring and firing based on citizenship status and national origin, and discriminatory I-9 and E-Verify practices. The OSC currently investigates anti-discrimination complaints not only from employees, but also from U.S. Citizenship and Immigration Services (USCIS). The NLRB is its newest partner.

While the NLRB’s traditional role has been to ensure employees’ right to unionize and to protect workers from unfair labor practices, it has become more involved in reviewing employers’ I-9 and E-Verify practices. In March 2012, the NLRB reached a settlement with Pacific Steel Casting Company when the company decided to enroll in E-Verify without ensuring that the enrollment would not violate the collective bargaining agreement. As part of the settlement, Pacific Steel withdrew its E-Verify enrollment. This set the precedent for the NLRB to evaluate issues surrounding employment verification practices within labor relations complaints.

This alliance between the NLRB and the OSC and any future agency cross-referral practices should not come as a surprise. As the government moves toward modernizing electronic data storage, sharing information between agencies will become easier. To ensure compliance, and to decrease the probability of cumbersome investigations from multiple agencies, it is important to work with legal counsel to develop and review your company’s employment eligibility verification practices.

IMMIGRATION: I-9 COMPLIANCE
Presented by: Sherry Lin, Mountain States Employers Council, Inc.

Sherry an immigration attorney in the Specialized Legal Services Program. Her practice focuses on employment based immigration, in addition to assisting employers with I-9 questions. Prior to joining Mountain States, Ms. Lin was the managing attorney at Lutheran Family Services Rocky Mountains serving refugees and asylees. She is a member of the American Immigration Lawyers Association, Colorado Chapter and has served in a number of committees over the years. Since being admitted into the bar, she has been actively engaging in a number of pro bono projects, such as participating in Citizenship Day and Legal Night, and representing individuals who sought asylum.

Presentation Summary
This seminar will provide an overview of recent changes to federal I-9 form and to the Colorado Affirmation Form. The sessions will also cover best practices and management of both sets of records.

Would you know what to do in the event of a cardiac emergency? Are your employees trained to recognize and care for an injured worker until the paramedics can arrive? CPR (cardiopulmonary resuscitation) and AED (automated external defibrillator) training can help when there may be only minutes to respond.

Pinnacol Assurance is offering CPR and AED training to policyholders and their employees. Topics include:

  • Learn how to perform CPR and respond to breathing and cardiac emergencies
  • Learn how to use an automated external defibrillator
  • Learn how to respond in the event of a choking emergency

Between improper installations, unsafe work practices and inadequate training, electricity continues to be a leading cause of both fatal accidents and OSHA citations in the workplace. This course will address specific OSHA and NFPA standards pertaining to safe electrical work practices.
