IMMIGRATION: I-9 COMPLIANCE
Presented by: Sherry Lin, Mountain States Employers Council, Inc.

aSherry an immigration attorney in the Specialized Legal Services Program. Her practice focuses on employment based immigration, in addition to assisting employers with I-9 questions. Prior to joining Mountain States, Ms. Lin was the managing attorney at Lutheran Family Services Rocky Mountains serving refugees and asylees. She is a member of the American Immigration Lawyers Association, Colorado Chapter and has served in a number of committees over the years. Since being admitted into the bar, she has been actively engaging in a number of pro bono projects, such as participating in Citizenship Day and Legal Night, and representing individuals who sought asylum.

Presentation Summary
This seminar will provide an overview of recent changes to federal I-9 form and to the Colorado Affirmation Form. The sessions will also cover best practices and management of both sets of records.

FTC ANNOUNCES ENFORCEMENT ACTIONS AGAINST DEALERS: ADVERTISED DISCOUNTS DEEMED DECEPTIVE

Last week the FTC issued a press release stating that it has entered into proposed consent orders with a Cleveland dealership and a Baltimore area dealership for alleged advertising violations that appeared on their respective websites. 

In the former case, the FTC alleged that the dealer advertised that particular Ford models are available at a specific dealer discount when “in fact, once consumers reach the dealership, they find out that [the dealership] has failed to disclose that the specific discounts are available for some, but not all, of the Ford models advertised.” 

In the latter case, the FTC alleged that the dealer advertised specific dealer discounts and prices as being generally available to consumers when “in fact, once consumers reach the dealership, they find out that there are significant restrictions on obtaining the advertised discounts or that the advertised discounts are not available in full.”  In particular, the FTC alleged: “In numerous instances, the advertised discount and price are subject to various qualifications and restrictions… for example, being a member of the military, being a recent college graduate, possessing a bank account at a particular bank, or owning a vehicle that has a lien on it.  In numerous instances, even if consumers meet all of these qualifications or restrictions, they cannot obtain the advertised discount and price.”

The FTC alleged that these are deceptive practices which violate Section 5 of the FTC Act. 

The proposed consent orders with each dealership (in which the dealerships do not admit or deny the alleged violations) would be in effect for 20 years and –

  1. prohibit the dealership from representing that a discount, rebate, bonus, incentive, or price is available unless the representation clearly and conspicuously discloses any material qualifications or restrictions, including but not limited to (a) a consumer’s ability to obtain such item, and (b) the vehicles available at the discount, rebate, bonus, incentive, or price;

  2. prohibit the dealership from misrepresenting: (a) the existence or amount of any discount, rebate, bonus, incentive, or price; (b) the existence, price, value, coverage, or features of any product or service; (c) the number of vehicles available at particular prices; or (d) any other material fact about the price, sale, financing, or leasing of motor vehicles;

In addition, the dealerships must retain their ads and promotional material for 5 years and file compliance reports with the FTC.

PINNACOL ASSURANCE - CPR AND AED TRAINING TO POLICYHOLDERS AND THEIR EMPLOYEES
REMINDER:  Members of the CADA safety program group are required to attend at least two safety seminars each year.  If the two-seminar requirement is not met, the 4% discount will be lost upon renewal and eligibility for group dividends also ends.*

Would you know what to do in the event of a cardiac emergency? Are your employees trained to recognize and care for an injured worker until the paramedics can arrive? CPR (cardiopulmonary resuscitation) and AED (automated external defibrillator) training can help when there may be only minutes to respond.

Between improper installations, unsafe work practices and inadequate training, electricity continues to be a leading cause of both fatal accidents and OSHA citations in the workplace. This course will address specific OSHA and NFPA standards pertaining to safe electrical work practices.
