AUTO INDUSTRY NEWS AT A GLANCE

Listed here are several articles pertaining to the auto industry in general that appeared recently in newspapers and other media outlets across the nation.

…more news articles are included at the end of this issue.

FTC LAUNCHES INVESTIGATION OF DEALERS THAT OPPOSED TRUECAR

The Federal Trade Commission is investigating whether dealers colluded to hurt TrueCar Inc. in 2011 and 2012 over vehicle price competition fostered by the online shopping site.  In a letter to dealers, the FTC said it is investigating whether some companies in the "retail automobile industry" committed anticompetitive acts "by agreeing to refuse to deal with TrueCar." TrueCar CEO Scott Painter said today in an interview that the FTC investigation did not stem from a TrueCar complaint.

The FTC is not answering questions, and the scope of the investigation is unclear. But during that period, many dealers criticized TrueCar's business model, which encouraged participating dealers to offer low transaction prices, in turn generating sales for the dealers. The FTC enforces laws that mandate fair business competition.

NADA Statement:  FTC investigation
The following initial statement was released by NADA on Friday, Sept. 13, 2013

I wanted to give you a heads-up on NADA’s response to an inquiry from Automotive News relating to the FTC investigation concerning TrueCar. Essentially, our response has five parts to it:

1. NADA is aware of the FTC investigation concerning TrueCar.
2. NADA did receive an inquiry from the FTC.
3. We have no reason to believe that NADA is a target of the investigation.
4. NADA will, of course, cooperate with any investigation.
5. This is the extent to which NADA can comment on this matter.

If you receive any calls from the media, you can forward them to me. Any non-media calls can be forwarded to Andy Koblenz, Jim Minnis or Bill Price.

David Hyatt
Vice President, NADA Public Affairs

CADA is unaware of any Colorado-based dealerships receiving an inquiry from the FTC.

EPA/DOE ISSUE VOLUNTARY USED-CAR FUEL ECONOMY LABEL
NADA 60-Second Email, 9/12/2013

The U.S. Energy Department (DOE) and the Environmental Protection Agency (EPA) have released a fuel economy label for optional, voluntary use by used-vehicle sellers. Labels can be printed or downloaded from www.fueleconomy.gov for light-duty vehicles dating to 1984. Dealers or private sellers interested in using the label to help with marketing are free to put it on or in vehicles or to hand it to prospective customers. A recent NADAguides.com survey suggests that fuel economy is currently top-of-mind for prospective purchasers.

KPA ANNOUNCES NEW ENVIRONMENTAL & SAFETY RISK ASSESSMENT, A COMPLIMENTARY TOOL USED TO REDUCE RISK

KPA announces a complimentary Environmental & Safety Risk Assessment, allowing managers to efficiently track and adhere to Federal and State Regulations and management practices. This tool is available to any dealership!

In response to increased regulatory inspections, compliance fines, and heightened injuries in the automotive industry, KPA has created the Environmental & Safety Risk Assessment. The customized, complimentary assessment provides dealers and collision centers with a method to manage the Environment and Safety liabilities of their operations. There are many requirements set by state and federal regulatory agencies including OSHA, EPA and DOT, as well as best management practices that can be implemented to reduce risk and injury of employees. This program is designed to assess company liabilities, allowing mangers to then implement solutions on their own.

“Top violations in the auto industry are typically issued for missing or inadequate training and written programs, and many managers are unaware that they are not in compliance. The Environmental & Safety Risk Assessment provides managers with easy and efficient methods to stay in compliance and reduce their overall level of risk,”
--Peter Zaidel, KPA Environment & Safety Product Director

The Environmental & Safety Risk Assessment manages compliance through a series of options and steps:

  1. Directs managers to easily determine which action items and requirements apply to their facility or dealership.
  2. Defines the responsibilities for each action item.
  3. Provides resources to complete each requirement.
  4. Provides a personalized to do list of how to keep individual departments safe and compliant.
  5. Checks off completed action items and requirements.
  6. Highlights outstanding action items and requirements.
  7. Start and stop this assessment as necessary.
