UNIFORM CONSUMER CREDIT CODE: RE-CAP OF KEY REQUIREMENTS
Attorney General office continues to audit dealers

The Attorney General’s office continues to regularly audit dealers for compliance with the Colorado Uniform Consumer Credit Code (“UCCC”).     A key focus is that the required ‘separate written cancellation form’ for GAP is being provided to consumers – with a copy retained in deal jacket files for proof that it was provided.  However, some audits have uncovered other, overlooked areas of the UCCC.  Ensure your dealership is in full compliance with all aspects of the UCCC – key areas are summarized below.  CLICK HERE for full details. 

  1. All Finance-related charges Must Be in APR—Except for Allowable ‘Additional Charges’
    Generally, any charge related to financing – must be included in the APR calculation.  Additional financing-related fees added by the dealer will typically violate the UCCC as they will not be included in the lender provided APR figure (also violates the federal Truth In Lending Act, “TILA”).
     
  2. GAP Requirements (Rule 8 Allows GAP as an “ Additional Charge”):
    Meeting all requirements below allows GAP to be sold for a ‘permissible additional charge” – this means the GAP fee does not have to be included in the APR calculation. Failure to meet these requirements and not include the GAP fee in the APR violates the UCCC and TILA.  

    1. GAP - Required Pre-Disclosures
    2. GAP – Contract Requirements
    3. GAP – Separate, Written Cancellation Form
      ***DEALERS must keep a copy of this separate cancellation form in the file to prove it was given to the consumer—and it should also be signed or initialed by the customer to acknowledge receipt.***  [Recordkeeping requirements must allow auditor to determine compliance; this is what UCCC auditors want to see].
    4. GAP –Customer must be provided certain key items at time of purchase

REMINDER:  Members of the CADA safetya program group are required to attend at least two safety seminars each year.  If the two-seminar requirement is not met, the 4% discount will be lost upon renewal and eligibility for group dividends also ends.*

Between improper installations, unsafe work practices and inadequate training, electricity continues to be a leading cause of both fatal accidents and OSHA citations in the workplace. This course will address specific OSHA and NFPA standards pertaining to safe electrical work practices.

Would you know what to do in the event of a cardiac emergency? Are your employees trained to recognize and care for an injured worker until the paramedics can arrive? CPR (cardiopulmonary resuscitation) and AED (automated external defibrillator) training can help when there may be only minutes to respond.
