PICKUP TRUCK BID FOR PAGOSA

Pagosa Area Water and Sanitation District (District) is seeking a Supplier to furnish up to four, 2013 or 2014 half-ton vehicles pursuant to the attached list. Bids are due 10:00 a.m. on January 29, 2014.  At 10:00 a.m. on January 29, 2014 the bid opening shall be held at the District Conference Room at 100 Lyn Avenue, Pagosa Springs, Colorado; all Bids that have been duly received will be opened publicly and read aloud.  All interested parties are invited to attend.

FTC ANNOUNCES NATIONWIDE SWEEP AGAINST 10 AUTO DEALERS

On Thursday, January 9, 2014, the Federal Trade Commission (FTC) held a press conference to announce “Operation Steer Clear,”   a nationwide sweep against deceptive auto dealer advertisements.

According to the complaints, the dealers made a variety of misrepresentations in print, Internet, and video advertisements that violated the FTC Act, falsely leading consumers to believe they could purchase vehicles for low prices, finance vehicles with low monthly payments, and/or make no upfront payment  to lease vehicles.

Nine auto dealers agreed to settle deceptive advertising charges, and the agency is taking action against a tenth dealer.  Dealerships in the following states were included in these actions, and all but two stores cited were franchised dealerships: California, Georgia , Illinois, North Carolina, Massachusetts, Michigan, and Texas.

SALE OF RECREATIONAL MARIJUANA DOES NOT CHANGE STATUS QUO FOR COLORADO EMPLOYERS

With the recreational sale of marijuana now legal under Colorado state law, it is important to understand that nothing has changed for employers from a legal standpoint, and that employers may continue to have and enforce their drug policies just as they could before January 1, 2014.

Colorado’s Amendment 64, Use and Regulation of Marijuana, contains the following language: “Nothing in this section is intended to require an employer to permit or accommodate the use … of marijuana in the workplace or to affect the ability of employers to have policies restricting the use of marijuana by employees.” Moreover, a Colorado Court of Appeals case from April 2013 affirmed that off-duty marijuana smoking is not protected under Colorado’s lawful off-duty activities law. Coats v. Dish Network, L.L.C. (Colo. Ct. App. 2013). While Mr. Coats has sought review by the Colorado Supreme Court, employers currently retain the authority to take whatever disciplinary action they wish in response to a positive drug-test result or on-the-job impairment.

MSEC recognizes that the status of marijuana is in flux and that its legal status could change as a result of a change in state law, removal of marijuana from Schedule I of the federal Controlled Substances Act, or even as a result of advances in drug-testing science. MSEC will continue to apprise its members of any change that may affect the employer/employee relationship.

Task Force Report on the Implementation of Amendment 64, 3/13/ 2013 (the Task Force, created by the Governor via executive order was asked to identify the legal, policy and procedural issues that need to be resolved, and to offer suggestions and proposals for legislative, regulatory and executive actions).   Section 16.1 of this report affirmed the following principles:

Guiding Principles:

  • Be responsive to consumer needs and issues
  • Develop clear and transparent rules and guidance for certain relationships, such as between employers and employees, landlords and tenants, and students and educational institutions
  • Take action that is faithful to the text of Amendment 64

Justification:
This recommendation seeks to clarify the uncertainty for employers and employees regarding their legal rights regarding employee use of marijuana during non-work hours. It is based on the Amendment 64 campaign argument that the initiative did not affect the ability of employers to maintain their current employment policies regarding off-site use of marijuana, or to create new ones, and on the 2012 State Ballot Information Booklet (Blue Book) statement that the Amendment would not affect the ability of an employer to restrict the use or possession of marijuana by employees.
