PARTICIPATION IN 2014 DEALERSHIP WORKFORCE STUDY NOW OPEN

Participation in the 2014 NADA Dealership Workforce Study is now open to NADA and ATD dealer members.

The study, conducted by NADA and ESI Trends (formerly DeltaTrends), is the industry’s most comprehensive analysis of the dealership workforce. It aims to provide dealers with the data to make informed recruiting and hiring decisions and help them meet their number-one challenge: attracting and retaining talented employees.

Dealers can enroll as individual dealerships or dealer groups using a secure, web-based process that involves completing a survey and uploading their payroll data. At the study’s close, each participating dealership will receive a complimentary customized report (Basic Report) comparing its own employee compensation, retention and turnover, work schedules, hours of operation and employee benefits programs against data aggregated on a regional and national basis. Participants also receive, free of charge, the Dealership Workforce Industry Report providing cogent analysis of the industry as a whole, including state-of-the-workforce and demographic trends, plus aggregated compensation, retention, and benefits data for each region of the U.S. Participants can purchase additional customized reports providing even more data.

NADA directors and ATAEs can help promote this important study by encouraging all dealer members in their states and regions to participate; the greater the level of participation, the more accurate the findings can be. Armed with the facts, dealers can address issues such as turnover (sales consultant is the highest turnover position at 62 percent), the “gender gap” (females make up only 18 percent of the dealership workforce), and generational issues such as the need to attract Gen Y employees. The 2013 study showed improvement: Dealerships are hiring more women and Millennials, salaries in general increased, and total dealership employee turnover, at 35 percent, is less than the government’s estimate of total separations in the entire private sector (41 percent).

FAIR CREDIT REPORTING COMPLIANCE POLICY & PROGRAMa

NADA’s Legal and Regulatory Affairs department has published a Fair Credit Compliance & Policy Program for dealers.  This guidance is in response to ongoing pressures from the federal Consumer Financial Protection Bureau (CFPB) targeted at retail automotive lenders.   While dealers were carved out of direct jurisdiction of the CFPB, the lenders to which auto loans are assigned were not.  Starting last March , the CFPB has been issuing highly publicized edicts and levying allegations that there is unintentional discrimination occurring in the auto retail lending industry (referred to as a “disparate impact” theory).  Despite requests from NADA and numerous members of Congress, the CFPB has not provided any details of the methodologies used to make these allegations.   Then, in December, the CFPB and the Department of Justice announced an enforcement action against Ally.

In light of this pressure and potential for legal action, lenders will be increasingly expecting dealers to demonstrate compliance with Fair Credit Reporting laws, in order to respond to CFPB actions. Many dealers, including some in Colorado, have been receiving notices by lenders that they must be compliant with Fair Credit Reporting laws.  This program is an effort to provide dealers with a comprehensive program, based on prior DOJ settlements that may enable to dealers to better respond to all lenders. 

While this gives dealers a way to begin addressing this challenge immediately, NADA will continue to fight this battle. In Jan. 25 remarks at the NADA Convention & Expo in New Orleans, outgoing association Chairman David Westcott said: "Our message is simple: the CFPB’s effort to coerce the industry into adopting flat fees will harm the car-buying public. Rest assured that the NADA will continue to lead the charge and defend in-dealership financing."
