Personnel files have important legal requirements, allowing you, as the employer, to document employee history, disciplinary actions, and investigations that have been conducted. These files have the ability to protect the dealership in the event of a legal dispute. Because of their significance, and the private information contained within, personnel files must be kept secure at all times. At the same time, they must be reasonably available as many states require that employees be allowed to review the information included in their own files.
Aside from being a legal right, there are other reasons why it is beneficial for employees to have access to their files:

  1. Employees can review their factual information (birth dates, social security numbers, etc.) and confirm this information is correct.
  2. Allowing employees access to their personnel information creates positive relationships and trust between managers and employees. The employee will realize there is nothing sinister or hidden within their files.
  3. Allowing employees access will assist in maintaining authentic documentation. It forces managers to properly communicate with their employees, provide constructive feedback, and to keep conjectures to themselves.

FEDERAL - NADA LEGISLATIVE PRIORITY ISSUES UPDATE

NADA’s legislative office is working on behalf of dealers on a number of legislative fronts. A few highlights are listed here; for a broader review of NADA’s current priority issues, please click here.

Auto Financing – Our current top legislative priority remains oversight of the Consumer Financial Protection Bureau (CFPB) and their continued attempt to curtail indirect auto financing. Nearly a year after the CFPB issued its auto finance guidance, Congress still does not have answers to fundamental questions regarding the CFPB’s position. NADA is communicating to legislators the importance of preserving “meet or beat” financing, and has produced a new infographic that provides a simple visual of the benefits of dealer assisted financing and the threat posed to the availability and affordability of auto credit.

Additionally, the House is expected next week to consider legislation (H.R. 3193) to reform the CFPB, including requiring Congressional approval of the Bureau’s budget. NADA supports this legislation to rein in the CFPB’s overreach. While it is unlikely the bill will be signed into law this Congress, it is important to use this opportunity to urge both Democrats and Republicans to seek greater transparency by the CFPB on auto financing issues.

Visiting with Members of Congress During Congressional Recesses - NADA urges dealers to meet with Senators and Representatives and invite them to visit their dealerships to discuss ongoing concerns with the CFPB and other federal issues impacting dealers. There are two upcoming Congressional recesses for both the House and Senate, March 17-21 and April 14-25.

J WILLIAM CROUCH PASSES AWAY

Long time Colorado automobile dealer, Bill Crouch of Cherry Hills Village, passed away February 27, 2014 in La Quinta, CA, where he spent the winter months. Bill was born, August 13, 1936, and raised in Tipton, Indiana, the second son of H. Paul Crouch, Sr. and Dorris Crouch. Growing up, he learned the car business from his dad, who was a Dodge - Plymouth and Nash Dealer in Tipton.

After graduating from the University of Colorado in 1958, Bill went to work for his older brother, Paul Crouch at Crouch Motor Company, a Desoto-Plymouth dealership in Boulder.
