ADVERTISING: A SHORT QUIZ

In the last two years, the FTC has been active in filing complaints and demanding consent orders from dealers on advertising practices. Dealers must carefully comply with state law advertising requirements. However, the FTC’s recent aggressiveness suggests that dealers should be concerned that they do not wind up in the agency’s crosshairs.

Signing an FTC consent order does not end the dealer’s pain. It is only the beginning. A typical consent order provides for FTC oversight of the dealer for twenty years and requires that the dealer make regular reports concerning its compliance efforts. Sometimes those reports have to be certified by an expensive outside observer. Any violation of the consent order can be enforced by an FTC action seeking civil penalties of up to $16,000 per day per violation.

  1. Under the Truth in Lending Act, if we advertise a low APR, we must also disclose the amount or percentage of the down payment, and the terms of repayment. True or False? 
  2. When we advertise an attractive APR, we must disclose any qualifiers such as the limit on the duration of the financing, and we must disclose the amount or percentage of the downpayment and the terms of repayment. True or False?
  3. We have some especially low lease rates. Since those are like the annual percentage rate, we can advertise the low Annual Lease Rate. True or False?
  4. In doing lease advertising, we think that we can use a toll-free number. We want to advertise a lease payment for a vehicle, but we believe that we can’t advertise just the payment and then refer a consumer to a toll-free number for further disclosures. True or False?
  5. If we advertise a price that is net of manufacturer incentives, but some customers may not qualify for them, we must disclose: “Not all customers will qualify for this price.”True or False?
  6. We believe we can help customers who have high interest rate loans and owe more on their vehicles than they are worth. We can sell them vehicles at lower interest rates to lower their payments. We must, however, disclose that “the purchase will include the payoff of the finance balance on your existing vehicle.”  True or False?

The FTC has taken numerous high profile enforcement actions recently. 
“Operation Steer Clear” announced January, 2014 is the latest —
a nationwide sweep will continue to target dealers throughout the country. 


This session will provide a review of the latest, high-profile enforcement actions by the FTC, review long-standing FTC directives that are often overlooked, and highlight areas that state regulators have stated are key problems.  Dealers can expect increased enforcement at all levels in the advertising and telemarketing arenas. Other key topics / highlights include:

  • Review of the latest FTC guide “.com Disclosures:  How to Make Effective Disclosures in Digital Advertising,” updated March, 2013
  • Recent FTC enforcement actions (March, 2012 / December 2012 / September 2013 / January 2014) – including ‘drip pricing’ warnings and implications for dealers
  • Important changes to the Telephone Consumer Protection Act (TCPA) – significant changes to prior consent requirements when calling or texting cell phones—even informational messages. FTC

BACK AND MATERIALS HANDLING

Strains due to lifting are one of the most frequent causes of injury for Pinnacol policyholders. Sixty percent of these claims involve the lower back and shoulder. Traditional approaches to controlling back injuries, such as proper lifting training and stretching programs, have not been successful
in reducing injuries. In this class, participants will learn the most effective strategies for reducing the frequency and severity of back injury claims. This class is designed for policyholders in “fixed industrial settings” such as manufacturing, warehousing and food processing.

Topics include:

  • The most high-risk job tasks for back and shoulder injuries

  • Ergonomic design principles for manual material handling
  • An evaluation of the seven common lifting techniques
