COLORADO WAGE PROTECTION ACT SIGNED
MSEC Hot Topics, June 2, 2014

Last Thursday, Gov. John Hickenlooper signed the Wage Protection Act into law. The bill aims to assist employees in receiving unpaid wages more quickly. It also authorizes the director of the Division of Labor in the Colorado Department of Labor and Employment to establish an administrative procedure to adjudicate wage claims of $7,500 or less and issue citations and notices of assessments for the amounts due.

Business interests squashed a similar bill to the Colorado Wage Protection Act of 2014 last year. The bill returned without criminal penalties and passed through both chambers of the General Assembly in the first week of May.

While portions of the new law went into effect immediately upon Gov. Hickenlooper’s signature, the major portions affecting employers will not take effect until January 1, 2015.

DAMAGE DISCLOSURE REMINDER AFTER RECENT HAIL STORMS

After the recent hail storms, numerous questions have arisen regarding damage disclosure requirements.

After recent hail storms hit Colorado, numerous questions have arisen regarding damage disclosure requirements.  The more frequently asked questions include:
 
1.Are there any special requirements or added details covering the disclosure of hail damage? 
§  No.  Hail damage is covered just like any other prior damage as described below.
§  Dealers must disclose all ‘material damage’ of which they have knowledge, and hail damage would fall under that general disclosure requirement.  This applies to both new and used inventory.  See attached alert for more details.

2.Is there a minimum dollar amount threshold, above which damage must be disclosed? 
§  No.  While some states do have specific dollar limits above which any prior damage to a car must be disclosed to the consumer, Colorado does not.  Generally in Colorado, the governing statutes and regulations require disclosure of damage that is “material.” 
 
3.Does CADA have a form available for damage disclosure? 
§  Yes.  CADA’s damage disclosure form was recently updated with guidance provided by attorney Mike Dommermuth.  CADA has the form available in duplicate format so a copy can be provided to the customer, which is recommended.  CADA can also provide you with a sample.

4.Do these disclosure requirements apply to dealer purchases from auctions or from other dealers? 
Yes.  The disclosure requirements in the motor vehicle laws apply to dealer-to-dealer or auction purchases.

BACK AND MATERIALS HANDLING

Strains due to lifting are one of the most frequent causes of injury for Pinnacol policyholders. Sixty percent of these claims involve the lower back and shoulder. Traditional approaches to controlling back injuries, such as proper lifting training and stretching programs, have not been successful
in reducing injuries. In this class, participants will learn the most effective strategies for reducing the frequency and severity of back injury claims. This class is designed for policyholders in “fixed industrial settings” such as manufacturing, warehousing and food processing.

  • The most high-risk job tasks for back and shoulder injuries

  • Ergonomic design principles for manual material handling
  • An evaluation of the seven common lifting techniques

  • An assessment tool to evaluate the recommended weight limits for lifting tasks

SMOKY HILL AUTOMOTIVE STUDENTS EARN 1ST PLACE AT FORD/AAA STUDENT AUTO SKILLS COMPETITION!

Earlier this month, two Smoky Hill Automotive students earned a 1st place trophy and scholarships at the 2014 State Ford/AAA Student Auto Skills Competition! 

Seniors Jared Freihoefer and Shane Cleavenger repaired their 2014 Ford Fiesta in 85 minutes by diagnosing and repairing a dozen "bugs" placed in their vehicle by master Ford technicians, and they had the highest-quality repairs of any State team. This earned the pair a 1st place state trophy, and their choice of scholarships to post-secondary schools, including a full-ride, two-year scholarship to Lincoln College of Technology in Denver. Scholarships totaled over $80,000 for Jared and Shane.
 
Smoky's 1st place winners and their instructor, Brian Manley, will embark on an all-expenses paid trip to Detroit, MI June 8-11, 2014, for the National finals of the Ford/AAA Student Auto Skills Contest. Highlights include the national contest on the front lawn of Ford Motor Company's World Headquarters, dinner at the Henry Ford Museum, and a tour of the River Rouge Truck Plant, where they build the Ford F-150.
 
These two students studied Saturdays, Sundays, and weekday evenings to familiarize themselves with the 2014 Ford Fiesta. Thank you to Mike Naughton Ford; this success would not have been possible without community support and the "get-it-done" attitude that had our student's best interests at heart.
 
In Colorado, the ten teams scoring highest on the state qualifying exam moved on to the "hands-on" state finals on Saturday, May 10th, at Lincoln College of Technology in Denver, CO.  In the "hands-on" competition, new 2014 Ford Fiesta vehicles were uniformly "bugged" so that each team had identical malfunctions to diagnose and repair.  The competition required repairs to be made with the highest quality workmanship in the lowest total time.
