Strains due to lifting are one of the most frequent causes of injury for Pinnacol policyholders. Sixty percent of these claims involve the lower back and shoulder. Traditional approaches to controlling back injuries, such as proper lifting training and stretching programs, have not been successful
in reducing injuries. In this class, participants will learn the most effective strategies for reducing the frequency and severity of back injury claims. This class is designed for policyholders in “fixed industrial settings” such as manufacturing, warehousing and food processing.

NADA SUPPORTS BIPARTISAN EFFORT TO REFORM CFPB AUTO LENDING GUIDANCE
  
NADA is urging Congress to pass HR 5403, a bipartisan bill that nullifies the Consumer Financial Protection Bureau's (CFPB) flawed guidance on auto lending and requires more transparency and accountability from the agency on future guidance.

The new bill, "Reforming CFPB Indirect Auto Financing Guidance Act," would allow the agency to reissue its guidance under a more transparent process.

As previously reported by GADA, in March 2013, the CFPB issued guidance that threatens to eliminate the flexibility of new-car dealerships to discount the interest rate offered to consumers to finance vehicle purchases. The CFPB claims that negotiated interest rates between dealers and their customers create a significant risk of unintentional "disparate impact" discrimination. However, there are a variety of legitimate business-related factors that can affect finance rates, such as beating a competing rate.

"HR 5403 is needed because it requires the CFPB to follow a transparent process when issuing auto finance guidance," said NADA Chairman Forrest McConnell. "The bill would rescind the 2013 auto finance guidance and require public participation for future guidance before it is issued."

NADA urges dealers to contact their House members today to co-sponsor HR 5403.

COLORADO'S WAGE PROTECTION ACT AND RETALIATION

On January 1, 2015, the major changes set out in the Wage Protection Act will go into effect. Current and former employees will be able to bring wage claims against their employers under this new statute and will have the option to participate in the State’s new administrative adjudication process. In addition to the new processes and rules set out under the Act, it is also important for employers to remember that current employees will be protected from discrimination and retaliation if they make a complaint or assert their rights under the Wage Protection Act.

The Colorado Wage Act explains that employers may not “intimidate, threaten, restrain, coerce, blacklist, discharge, or in any manner discriminate against any employee” who asserts their rights under the Wage Act. C.R.S. § 8-4-120. A violation of this section is defined as a misdemeanor crime. Since the Wage Protection Act amends and adds to the Wage Act, employers should ensure that employees who discuss or pursue their rights under any part of the Wage Act, including the new Wage Protection Act complaint and administrative processes, are not discriminated or retaliated against. As part of this effort, employers should make sure that supervisors are aware of the Wage Protection Act and are trained to prevent any unlawful acts from being directed at an employee who pursues his or her rights under the Wage Act.

JOSEPH C. HERMAN PASSES AWAY

Vancouver, WA—The automotive industry lost a significant and well-known leader this week with the passing of Joseph C. Herman. Joe passed early on the morning of October 29, 2014 following a year-long battle with pancreatic cancer.

Through Joe's selfless approach to life and desire to help others, he succeeded in positively influencing countless lives over the course of his 40-plus years in the automotive retail industry.
His was a career marked by industry firsts and successes at the highest levels. From the manufacturer side to some of the nation's largest dealer groups, Joe left an indelible mark on the automotive industry, and, throughout his career, directly managed more than 215 dealerships and thousands of automotive professionals.

Joe began his automotive career in the 1960's selling cars at Shrewsbury Volkswagen in New Jersey while, at the same time, serving as 2nd Lieutenant in the U.S. Army Reserve. Over the following decades he held leadership positions at World-Wide Volkswagen, Corp., Porsche Audi Eastern, Porsche Audi Manhattan, and Herman + Miller Porsche Audi. Additionally, he spearheaded the creation of one of the nation's first consolidated automotive groups: US Auto Group.

In the early 1990's, he served as the COO and Executive Vice President for EMCO/United Auto Group, which later became the Penske Automotive Group. He then spent nearly eight years as President and CEO of the Planet-Potamkin Automotive Group before joining Group 1 Automotive as its Senior Vice President of Operations.

In 2010, Joe joined the Kuni Automotive Group as its COO and helped double annual revenue from under $500 million to more than $1 billion. In August of this year, the company elevated him to Executive Vice President and, more recently, announced the creation of a new "best in class" dealership award that will be named "The Joe Herman Challenge Cup."

Joe also served on and chaired numerous regional and dealer councils for various brands, and sat on OEM advertising and marketing committees. In recent years, he was a frequent speaker, panelist and moderator at industry events.

Other endeavors included acting as Chairman of Herman Advertising, CEO and Founder of Rosetta Advisors LLC, Director with Techvolutions, and serving on the industry advisory board of Mobile Productivity, Inc.

Joe was born on June 9, 1942 in Pittsburgh, PA to Conrad Earl and Longina Valerie Herman. He attended the American School in Germany and, following his graduation from Red Bank Catholic High School in Red Bank, NJ, studied at Duquesne University and Monmouth College. He is survived by his wife Kathryn Herman, son Christopher Scott Herman and daughter Rebecca Brooke Herman.
