EMISSION INSPECTION CHANGES FOR 2015: IMPLEMENTATION BASED ON REGISTRATION DATE / ADDED CLARIFICATIONS
On January 2, 2015, several changes to the emission inspection program for gasoline-powered vehicles go into effect. Click here to review the prior article.
A key change is that the emission exemption for new vehicles will increase from four (4) to seven (7) model years.
For implementation of this change, the registration date is the key. After Jan. 2, 2015, the programming in the computer system at counties will have been set to not require tests in the first seven model years. County personnel rely on what the computer system indicates regarding whether an emissions test is required or not. At this point, vehicles that are not currently exempt, but will become exempt on January 2, 2015*, dealers can stop providing the voucher or test and advise anyone who might have paperwork to be able to go the DMV before Jan. 2nd (i.e., a cash customer with time over the holidays) that if they go after that, an emissions test will not be required. 
*Important note: for the emission exempt period to remain effective, a vehicle must have at least one year of the model year exemption remaining when sold. This is not changing from how it is today.
Additionally dealers are only required to affix an emission exempt sticker to new vehicles. A used vehicle that is still within the emission exempt period does not need a sticker (for example, a vehicle comes in from out of state, a windshield is replaced, or for whatever reason the used vehicle that is still exempt does not have a sticker). C.R.S. 42-4-310 (1)(b)(II).

NADA SUPPORTS BIPARTISAN EFFORT TO REFORM CFPB AUTO LENDING GUIDANCE
NADA is urging Congress to pass HR 5403, a bipartisan bill that nullifies the Consumer Financial Protection Bureau's (CFPB) flawed guidance on auto lending and requires more transparency and accountability from the agency on future guidance.
The new bill, "Reforming CFPB Indirect Auto Financing Guidance Act," would allow the agency to reissue its guidance under a more transparent process.
As previously reported by NADA, in March 2013, the CFPB issued guidance that threatens to eliminate the flexibility of new-car dealerships to discount the interest rate offered to consumers to finance vehicle purchases. The CFPB claims that negotiated interest rates between dealers and their customers create a significant risk of unintentional "disparate impact" discrimination. However, there are a variety of legitimate business-related factors that can affect finance rates, such as beating a competing rate.
"HR 5403 is needed because it requires the CFPB to follow a transparent process when issuing auto finance guidance," said NADA Chairman Forrest McConnell. "The bill would rescind the 2013 auto finance guidance and require public participation for future guidance before it is issued."
NADA urges dealers to contact their House members today to co-sponsor HR 5403.
