FTC ACTION: AUTO DEALERSHIP TO PAY $80,000 PENALTY FOR VIOLATING 2012 ORDER PROHIBITING DECEPTIVE ADVERTISING OF VEHICLE COSTS

A West Virginia auto dealer, Ramey Motors Inc., has agreed to pay an $80,000 civil penalty to settle a Federal Trade Commission lawsuit brought in 2014. The FTC charged Ramey Motors with violating the terms of a 2012 consent order with the FTC that barred it from deceptively advertising the cost of buying or leasing cars. The civil penalty settlement resolves charges that Ramey Motors' ads violated the consent order by concealing important terms of sale and lease offers, such as a required down payment, and failing to make credit disclosures clearly and conspicuously, as required by federal law.  Click here for the FTC announcement.

This article continues a regular series that will review various state-level compliance topics in alphabetical order to provide reminders on compliance requirements and relevant resources that are available.  The topics are being pulled from the CADA Colorado Dealer Compliance Guide

Topic #6: Colorado Consumer Protection Act


The Colorado Consumer Protection Act ("CCPA") identifies a number of acts that are ‘deceptive’ and provides for the award of triple damages and attorney fees.  Numerous general provisions apply to all businesses, and there are provisions specific to motor vehicles. Dealerships should be aware of all provisions due to the triple damages; but a few of the provisions specific to motor vehicles include:

  • Accepting a motor vehicle as a trade-in on the purchase or lease of another motor vehicle and then selling or leasing that trade-in before financing of the new purchase or lease is approved;
  • Failing to disclose in writing that a motor vehicle is a salvage or lemon buy-back vehicle or knowingly failing to disclose prior material damage.
    • NOTE: salvage and lemon buy-backs do not have an awareness requirement on the part of the dealer—these are “strict liability”; the dealer would violate even if unaware of the salvage or lemon status.  For these reasons, dealers should make extra efforts to identify such issues prior to sale.  [Especially if you are taking in a trade that has been through a state that is not fully participating in the National Motor Vehicle Title and Information System (NMVTIS), added due diligence should be conducted.  A map of the status of various states is below].



  • The CCPA also contains a security breach notice requirement. Dealerships need to ensure proper handling of a computer system breach that may compromise customer personal information.  Colorado requires a “prompt investigation” to determine the likelihood that personal information has been or will be misused.  If the internal investigation determines personal information has been compromised and is reasonably likely to occur, notice must be provided.  Dealers who experience a system breach should consult the specific provisions in C.R.S. 6-1-716.

EMV MANDATE FOR CREDIT CARD PROCESSING: FACT VS FICTION

There has been an abundance of mis-information and dis-information regarding the pending EMV mandate for merchants by the Card Associations (Visa, Mastercard, Amex, Discover and JCB) and the ATM networks (NYCE, Accel, Shazam, Star etc). 

Driven by the ever increasing instances of fraud - 8
BILLION and growing, the United States is the unrivaled
leader in credit card usage and the last to begin the
conversion to a safer transaction environment.

The focus of this article is to assist our valued merchants with making the best EMV decisions for their businesses and to assist with smooth and seamless implementation and transition.

Let's begin with the basics -

What is EMV?


EMV is the acronym for Europay/Mastercard/Visa (The three companies which originally created the standard - this standard is now managed by EMVCo, a consortium with control divided equally among Visa/Mastercard, JCB, American Express, China Union Pay and Discover), and specifically refers to credit cards that use a computer chip to store cardholder data as opposed to the status quo magnetic stripe.  Unlike traditional "swiped" transactions, the Chip card creates a unique and individual encryption for EVERY transaction, thus making data theft significantly more difficult.

The card associations have mandated that all US merchants have the capability to facilitate "chip" transactions by October, 2015.   Although it is notable that Gas Stations and ATM's have been given extensions into 2017 and 2018.
