Includes a Waste Tire Recycling Fee of $1.50 for each New Tire Sold
The Colorado Department of Public Health & Environment (CDPHE), Hazardous Material and Waste Management Division regulates the disposal of Waste Tires.  As retailers that generate waste tires, dealerships are waste tire facilities and covered under registration, reporting and other requirements.    The Waste Tire program area covers automotive retailers and all businesses that come in contact with the tire lifecycle. 
Specifically for dealers, the following key requirements apply:

  1. REGISTRATION: Facilities that generate, collect, store, process and/or use waste tires must register. 
  2. DECAL/CERTIFICATE: After registration, display and recordkeeping requirements apply,
  3. USE A REGISTERED HAULER: All tires must be transported by a state registered and bonded hauler (dealers will need to check for required decals on hauling vehicles).
  4. MANIFEST FORMS COMPLETED UPON TRANSFER: Haulers are required to provide a copy of a Uniform Waste Tire Manifest (Form WT-2) for each load of tires, including signatures from both the hauler and waste tire generator/dealer.
  5. WASTE TIRE RECYCLING FEE COLLECTION/REMITTANCE: Retailers of NEW motor vehicle tires must collect (as of Nov. 1, 2007) a Waste Tire recycling fee of $1.50 on each NEW tire sold, provide a specific disclosure on each invoice, and file a specific tax return form remitting these fees.  Visit https://www.colorado.gov/pacific/cdphe/wastetirefee (electronic remittance options are available).

Unfair and Deceptive Acts and Practices Enforcement: Is your Facility at Risk?

Protecting your dealership from illegal practices.

Dealers have plenty to worry about when it comes to rules and regulations governing the industry, but perhaps the most harrowing are Unfair and Deceptive Acts and Practices (UDAP).

UDAP statutes are consumer protection laws that address what lawmakers consider to be “unethical” or otherwise “bad” business practices. The Federal Trade Commission prohibits unfair or deceptive acts or practices. These statutes have far-reaching implications for auto dealers because they provide for enforcement by the government to stop the practices, individual actions for damages brought by consumers who are hurt by the practices, and even criminal liability.

Dealers must be aware that these statutes are extremely broad and not only prohibit acts and practices that fall directly under the purview of specific laws, but also any other practice that is determined to be unfair or deceptive to the consumer. A behavior can be found to be unfair and deceptive and thus actionable even though it does not constitute fraud, break of contract, or negligence under more traditional law. As a result, UDAP claims are a favorite among consumer attorneys- especially those seeking class action lawsuits.

These are a wide variety of dealer sales, F&I, and advertising practices that may be considered to be unfair or deceptive by regulators or courts. Some of these are commonly known, while others may surprise you.

In this informative webinar, KPA F&I experts Jim Radogna and Ryan Lane will address these potential and legal pitfalls and suggest best practices for avoiding being caught up a “UDAP Trap.”

This webinar is highly recommended for dealership upper management as well as sales managers, F&I personnel, sales consultants, and others- anyone who interacts with, or markets to, consumers.
